O Direito enquanto teoria da exploração e opressão : uma análise a partir das pessoas anti-normativas

Abstract

Resumo: Este trabalho surge de um espaço de contrariedade à noção predominante no acúmulo da teoria do direito, no que se refere ao direito enquanto manejador de relações entre iguais, promotor de justiça, caminho viável à emancipação de pessoas subalternizadas ou, ao menos, ferramenta tática. Oposição construída a partir da aplicação do método marxista, na forma do materialismo histórico dialético, por sobre o "sujeito de direitos", investigando por sobre as relações sociais que constroem essa figura etérea e idealizada para dar verniz de justiça a relações política e economicamente desiguais e exploratórias. A análise parte das relações sociais mais simples de modificação do meio com o fim de garantir a sobrevivência, em uma investigação das pessoas que desenvolvem estas relações e dos mecanismos que lhes impõe essa posição perante a estrutura da sociedade. Uma busca que perpassa a necessidade de deslocamento do espaço de universalidade em que o sujeito explorado (e revolucionário) foi alocado pelas teorias marxistas de maior destaque e pelas experiências socialistas do Século XX. A compreensão que funda este trabalho se dá pela necessidade de entender quem são as pessoas que trabalham, porque o fazem e o papel do direito na manutenção desta lógica, construindo os espaços anti-normativos que garantem a normatividade e, assim, a ordem social fundada em privilégios. O direito não pode ser aprimorado para promover igualdade, por ser ele parte do aprimoramento da desigualdade. O direito não pode ser reformado, o direito precisa ser extinto.

Abstract: This work arises from a space of opposition to the prevailing notion in the accumulation of the theory of law, with regard to law as a manager of relations between equals, promoter of justice, a viable path to the emancipation of subordinate people or, at least, a tactical tool. Opposition built from the application of the Marxist method, in the form of dialectical historical materialism, over the "subject of rights", investigating the social relations that build this ethereal and idealized figure to give a veneer of justice to politically and economically unequal relations and exploratory. The analysis starts from the simplest social relations of modification of the environment in order to guarantee survival, in an investigation of the people who develop these relations and the mechanisms that impose this position on them in the structure of society. A search that permeates the need to shift the space of universality into which the exploited (and revolutionary) subject was allocated by the most prominent Marxist theories and by the socialist experiences of the 20th century. The understanding that underlies this work is due to the need to understand who the people who work are, why they do it and the role of law in maintaining this logic, building the anti-normative spaces that guarantee normativity and, thus, the founded social order in privileges. The law cannot be improved to promote equality, as it is part of the improvement of inequality. The law cannot be reformed, the law must be extinguished.
