Desenho de sistema de disputa : estudo sobre a tutela processual adequada em relação ao direito à saúde pública no Brasil

Resumo: O presente trabalho tem por objetivo discutir o modelo de processo para tratar de temas relacionados ao direito à saúde da população e o dever do Estado de garantilo através de políticas econômicas e sociais. A saúde individual e coletivo que se consuma à medida que todos possam gozar dela. Por isso, o sistema público de saúde é o instrumento de intervenção estatal instituído pela Constituição Federal para proteger o interesse individual e coletivo. Porém, o tratamento exclusivamente judicial se tornou incapaz de tutelar adequadamente esse direito sob a perspectiva coletiva. A tutela judicial, de característica individual, não consegue corrigir as vicissitudes do sistema pública e reorientar a atuação administrativa, sendo privilegiado das classes econômicas mais abastadas em razão da estrutura deficitária de acesso à assistência jurídica gratuita no país. Mesmo assim, a jurisdição estatal é um importante canal de uniformização da interpretação do direito, que funciona muito bem para orientar os critérios distributivos do direito à saúde. Todavia, não pode ser o único canal de acesso à justiça, razão pela qual o sistema processual depende do desenvolvimento de métodos processuais que promovam o intercâmbio entre as esferas extrajudicial e judicial. Neste sentido, o sistema multiportas é novo paradigma da justiça civil do século XXI, que introduz novos atores e técnicas processuais para solucionar as demandas sociais. Com efeito, a administração pública passa a ter o dever de autogerir suas próprias crises, sobretudo em razão das reformas na legislação processual da última década, que estabeleceram a política de prevenção e de resolução administrativa dos serviços públicos em geral. Com isso, o Estado brasileiro tem o dever de integrar a justiça consensual e as instituições provedoras e protetoras do direito à saúde a responsabilidade de formar um modelo de processo dialógico e cooperativo. A metodologia processual do desenho de sistemas de disputas proporciona um formato customizado de processo que possibilita aumentar o raio de alcance do acesso à justiça e ao SUS, criando condições para proporcionar benefícios individuais e coletivos. A convenção de um sistema desta espécie pressupõe consenso, cooperação e controle preventivo judicial, com vistas a proteger os interesses dos formalmente representados e dos sujeitos ausentes. Todas as técnicas processuais conhecidas podem ser aplicadas, combinadas e sequenciadas aos mais variados temas, e novas técnicas também podem ser desenhadas. Por conta disso, a jurisdição estatal deve se transformar no caminho processual para definir as regras de direito, para tratar de questões coletivas ou para solucionar questões em que as etapas da justiça consensual não foram capazes, evitando, desta forma, a judicialização desnecessária, repetitiva e predominantemente individual. Abstract: This research aims to discuss the model civil process for dealing with issues related to the population's right to health and the State's duty to guarantee it through economic and social policies. Health is an individual and collective right which is consummated as far as everyone can enjoy it as well. Therefore, the public health system is the instrument of state intervention established by the Federal Constitution to protect individual and collective interests. However, the exclusively judicial treatment became incapable to protect it from a collective perspective. Judicial protection, which has an individual characteristic, is not able to correct the problems of the public system and to reorient administrative action, and it has been a privileged by the wealthier economic classes because of the failure structure of free access to legal assistance in the country. Even though, state jurisdiction is an important standard of interpretation the law, which works very well to guide the distributive criteria of the right to health. However, it cannot be the only channel of access to justice, which is why the procedural system depends on developing procedures that promote exchange between the administrative and judicial spheres. In this sense, the multi-door system is a new paradigm of civil justice in the 21st century, which introduces new actors and procedural techniques to solve social demands. Indeed, the public administration now has the duty to self-manage its own crises, especially due to the reforms in procedural legislation in the last decade, which established the policy of prevention and administrative resolution of public services in general. Therefore, the Brazilian State has the duty to integrate the consensual justice and the institutions responsible to promote and to protect the right to health have the duty to perform a model of civil procedure which increases the dialogue and cooperation to achieve mutual goals. The methodology of design of dispute systems provides a customized procedure that makes possible to increase the reach of access to justice and the Brazilian health system, creating conditions to provide individual and collective benefits. The convention of a system of this kind presupposes consensus, cooperation and preventive judicial review, leading to new a perspective of protecting the interests of those who are formally represented and of those who are absent. All known procedural techniques can be applied, combined and sequenced to the most varied themes, and new techniques can also be designed. Therefore, the state jurisdiction must become the procedural path to define the rules of law, to address collective issues or to resolve issues in which the steps of consensual justice were not able, thus avoiding unnecessary, repetitive judicialization and predominantly individual claims.
