Acordo de não persecução cível : noções e aplicabilidade à luz do microssistema de tutela coletiva e de tutela dos direitos

Resumo : O presente trabalho busca analisar o acordo de não persecução cível, introduzido no ordenamento jurídico brasileiro pela Lei 13.964/2019, que alterou a Lei 8.429/1992. A mudança legislativa, no entanto, apenas permitiu a celebração do acordo, sem trazer maior regulamentação legal ao instituto, o que é fonte de dúvidas acerca de sua aplicabilidade prática e, uma vez superada esta questão, quais os limites e balizas para sua celebração. Este trabalho intentou responder a estes questionamentos. Para tanto, valeu-se da pesquisa doutrinária e jurisprudencial, a fim de compreender que o acordo de não persecução cível se insere num movimento maior que o ordenamento jurídico brasileiro tem desempenhado em
direção a soluções consensuais de conflitos, visando à melhor tutela do direito material. Esse movimento é sentido no direito sancionador e, mais especificamente no campo processual, as soluções autocompositivas também têm se espraiado pelo microssistema de tutela coletiva, no qual a Lei 8.429/1992 se insere, sendo adotadas mesmo ao se tratar dos chamados direitos indisponíveis. Esta compreensão se mostra fundamental à análise que se fará acerca do acordo de não persecução cível, demonstrando-se que sua aplicação é possível e muitas vezes recomendada, atendendo ao interesse público, e que as balizas e noções para tanto podem ser buscadas em institutos negociais constantes do microssistema de tutela coletiva,bem como em regulamentação dos próprios legitimados pela Lei 8.429/1992 para ações de improbidade. Conclui-se, por fim, que o acordo de não persecução cível veio trazer novos ares ao campo da improbidade administrativa, e consubstancia a passagem, nesse campo, à busca de soluções consensuais que visem a tutelar os direitos materiais envolvidos de forma adequada, tempestiva, efetiva e eficiente. Abstract: This study aims to analyze the civil non prosecution agreement, introduced in the Brazilian legal system by federal Law nº 13.964/2019, which altered federal Law nº 8.429/1992. This legal change, however, only generically allowed such agreements, and was not followed by any other legal regulations, which results inquestions regarding its applicability and, surpassed that, what are the limits and thresholds to closing those agreements. This study intends to answer some of these questions. For that, doctrine and jurisprudence were researched, reaching the comprehension that the civil non prosecution agreement is inserted in a much larger movement of the Brazilian legal system towards consensual dispute resolution, seeking the best solution to the conflicts involving dishonesty in the public administration. This movement resounds in the sanctioning law and, more specificallyin the procedural law, consensual dispute resolution has also become a part of the collective civil microsystem, in which federal Law nº 8.429/1992 is inserted, being adopted even when discussions involve so called unnegotiable rights. This understanding is fundamental to the analysis of the civil non prosecution agreement, showing that its adoption is possible and, in most cases recommended, favoring public interest, and that the notions and thresholds for its use can be found in other negotiation instruments present in the collective civil microsystem, as well as in regulations created by the entities allowed by federal Law nº 8.429/1992 to seek punishment for dishonesty in the public administration. This study concludes that the civil non prosecution agreement is a breath of fresh air in the field of penalties fordishonesty in the public administration, and represents the passage, in this area, towards consensual dispute resolution, with the objective of best fulfilling the rights involved in an adequate, timely, effective and efficient way.
