Resumo : O presente trabalho visa expor e problematizar a questão do estigma da mulher ante o sistema penal brasileiro, o qual é permeado por uma lógica punitivista, voltada à preservação de desigualdades. Assim, foi realizada uma análise quanto à atribuição do papel social da mulher e suas consequências, principalmente acerca da violência de gênero, a qual acaba difundida, inclusive, pela atuação das instâncias policiais e jurídicas como meio de manutenção do discurso dominante, ensejando o reforço do estigma feminino e a demanda por maior proteção às vidas das mulheres. O estudo dogmático acerca da inclusão da qualificadora do feminicídio evidenciou que esta é atravessada pela falta de clareza em diversos
aspectos, e admite interpretações de caráter excludente, discriminatório e até mesmo prejudicial às vítimas, muito embora se faça essencial para o reconhecimento da situação de extrema violência à que as mulheres estão expostas. Além disso, verificou-se que ao visar a manutenção do status quo, o sistema jurídico reproduz o racismo e o sexismo, de modo que atribui à vida da mulher racializada maior carga de desvalor, e desempenha importante papel no controle do corpo feminino. O crescente número de feminicídios no Brasil demonstra que a inclusão da categoria em nosso Código Penal não é o suficiente para por si só promover a igualdade de gênero, de modo que é necessária a adoção de medidas de combate à
violência de gênero fora do sistema penal, mas não se pode ignorar que este possibilita maior mobilização para o combate do problema, pois lhe confere reconhecimento. Abstract: The present work aims to expose and problematize the question of the stigma of women before the Brazilian penal system, which is permeated by a punitive logic, aimed at the preservation of inequalities. Thus, an analysis was carried out regarding the performance of the social role of women and its consequences, mainly regarding gender violence, which ends up being disseminated, including, through the practice of police and legal policies as a mean of maintaining the dominant discourse, enabling the reinforcement of the female stigma and the demand for greater protection of women's lives. The dogmatic study about the inclusion of the qualifier of feminicide showed that this is crossed by the lack of clarity in several aspects, and admits interpretations of an exclusionary, discriminatory character and even to the victims, although it is essential for the recognition of the extremely harmful situation violence to which women are exposed. In addition, it was found that, in order to maintain the status quo, the legal system reproduces racism and sexism, so that it attributes a greater burden of devaluation to the life of racialized women, and plays an important role in controlling the female body. The growing number of feminicides in Brazil demonstrates that the inclusion of the category in our Penal Code is not enough to by itself promote gender equality, so it is necessary to adopt measures to combat gender violence outside the penal system, but can’t be ignored that it allows greater mobilization to combat the problem, as it confers recognition to it.
