Uma abordagem do terceiro mundo ao direito internacional ambiental

Abstract

Resumo : As Abordagens do Terceiro Mundo ao Direito Internacional (TWAIL) são constituídas como um movimento intelectual e político que se propõe a efetuar uma releitura do Direito Internacional a partir da perspectiva do Terceiro Mundo, desde temas centrais à disciplina. Nesse sentido, a pesquisa objetivou contrapor a narrativa tradicional atinente às questões ambientais, que levariam à fundação do Direito Internacional Ambiental, à concepção crítica do Terceiro Mundo ao cenário ambiental internacional. Por meio de uma revisão histórico-bibliográfica e de uma análise em recortes, com base nos aportes teóricos e metodológicos de autores que integram referido movimento, foi possível compreender que, embora o Direito Internacional Ambiental tenha sido construído com o propósito de estabelecer parâmetros universais a serem seguidos por todos os Estados, independentemente de seu grau de desenvolvimento econômico e social ou de responsabilidade pelas questões ambientais que emergiam, a luta e a resistência contrahegêmonica do Terceiro Mundo foram fundamentais para a consolidação de institutos e princípios jurídicos internacionais que considerassem suas necessidades e seu posicionamento na ordem global. Além disso, para além da perspectiva dos Estados ou indivíduos ao Direito Internacional, tem-se que é necessário considerar a atuação dos povos do Terceiro Mundo, especialmente aqueles não-ocidentais, periféricos e, por vezes, marginalizados, a fim de se alcançar outras visões de mundo possível, em busca de um direito pluriversal e efetivamente dialógico.

Abstract: The Third World Approaches to International Law (TWAIL) are constituted as an intellectual and political movement that aims to make a reinterpretation of international law from the perspective of the Third World, from central themes for the discipline. In this sense, the research aimed to oppose the traditional narrative related to environmental issues, which would lead to the foundation of International Environmental Law, to the critical conception of the Third World to the international environmental scenario. Through a historical and literature review and an analysis on clippings, based on the theoretical and methodological contributions of authors who are part of that movement, it was possible to understand that, although International Environmental Law was built with the purpose of establishing universal parameters to be followed by all States, regardless of their degree of economic and social development or responsibility for the environmental issues that emerged, the Third World counter-hegemonic struggle and resistance were fundamental for the consolidation of international legal institutes and principles that considered their needs and their position in the global order. Moreover, beyond the perspective of States or individuals to international law, it is necessary to consider the actions of Third World peoples, especially those non-Western, peripheral and, at times, marginalized, in order to reach other possible worldviews, looking for a multi-universal and effectively dialogical law.
