Como os juristas viam o povo? : uma história do conceito no pensamento civilista brasileiro na transição para o século XX

Resumo: O presente trabalho procura contribuir com a historiografia da cultura jurídica brasileira a partir da investigação do conceito de povo no pensamento civilista entre a proclamação da República e a promulgação do Código Civil de 1916, sem pretensão de exaurir o tema. Primeiramente, foram realizadas algumas reflexões de ordem metodológica. Nesse sentido, tentou-se definir certas preocupações a serem perseguidas no decorrer investigação. Tendo isto em vista, optou-se por selecionar o pensamento jurídico como o tipo de fonte para análise: certos livros e artigos cujo conteúdo abarca o termo "povo". A literatura sobre a cultura jurídica no período indica um movimento de transição na dimensão jurídica dos fins do século XIX: a tensão (não excludente) entre continuidades de uma estrutura "tradicional" e o desejo de "modernizar" o direito por uma ruptura com o passado. Então, buscou-se alguns indícios de como o conceito de povo foi utilizado nesse cenário de mudanças. A paisagem do início da República é importante para investigar o conceito, visto que no período a tensão entre o "velho" e o "novo" possui particularidades. Além disso, a codificação civil é importante marco temporal, pois representava uma tentativa de ruptura (ao menos formal) com o passado no direito civil. Diante da amplitude desse cenário, porém, foram levantados apenas indícios de certas linhas de movimento da cultura jurídica do período próximas à categoria "povo". Nesse sentido, igualdade, cidadania e identidade nacional foram alguns dos elementos da tensão entre o "arcaico" e o "moderno" no período e compunham o entorno do conceito de povo em textos de alguns dos juristas de destaque no direito civil dentro do recorte temporal elegido. A partir disto, buscou-se perceber traços das linhas de transição na semântica do conceito de povo em trabalhos publicados na Revista O Direito. Investigou-se indícios de como a categoria estudada era manejada pelo pensamento civilista diante de uma certa variação de significados entre tendências de permanência e ruptura. Neste itinerário, os artigos selecionados foram divididos de acordo com o tipo de análise que empreendiam e o ramo do direito civil que tematizavam. Com efeito, tentou-se delinear, a partir da interpretação dos usos do conceito de povo entre os textos analisados, alguns elementos da transição pela qual passava a cultura jurídica brasileira. Abstract: The present work seeks to contribute to the historiography of Brazilian juridical culture from the investigation of the concept of people in civilist thought between the proclamation of the Republic and the promulgation of the Civil Code of 1916, without pretending to exhaust the theme. First, some methodological reflections were made. In this sense, an attempt was made to define certain concerns to be pursued during the investigation. With this in mind, it was decided to select juridical thinking as the type of source for analysis: certain books and articles whose content includes the term "people". The literature on juridical culture in the period indicates a transition movement in the juridical dimension at the end of the 19th century: the (non-exclusive) tension between continuities of a "traditional" structure and the desire to "modernize" the law for a break with the past. So, some indications of how the concept of people was used in this scenario of changes were sought. The landscape of the beginning of the Republic is important for investigating the concept, since in the period the tension between the "old" and the "new" has its particularities. In addition, civil codification is an important time frame, as it represented an attempt to break (at least formally) with the past in civil law. Considering the breadth of this scenario, however, only indications of certain lines of movement in the legal culture of the period, close to the "people" category, were raised. In this sense, equality, citizenship and national identity were some of the elements of the tension between the "archaic" and the "modern" in the period and comprised the surroundings of the concept of people in texts by some of the prominent jurists in civil law within the time frame elected. From this, it was aimed traces of the transition lines in the semantics of the concept of people in works published in Revista O Direito. It was investigated evidences of how the studied category was handled by civilist thought in the face of a certain variation in meanings between tendencies of permanence and rupture. In this itinerary, the selected articles were divided according to the type of analysis they undertook and the branch of civil law they dealt with. In effect, an attempt was made to outline, based on the interpretation of the uses of the concept of people among the texts analyzed, some elements of the transition that the Brazilian juridical culture was going through.
