A atuação dos Tribunais de Contas estaduais no controle da política educacional : conformação de uma nova agenda de fiscalização

Abstract

Resumo: Esta tese tem como objetivo mapear a atuação dos Tribunais de Contas (TC) estaduais e do Distrito Federal no controle da política educacional e analisar suas práticas na constituição de uma nova agenda de atuação na área. Para isso, realiza uma pesquisa de abordagem qualitativa, de caráter exploratório e documental, com uso complementar de estratégias de quantificação para apresentação dos dados. Parte-se da seguinte problemática: quais práticas têm sido desenvolvidas pelos TC estaduais e do Distrito Federal no controle das políticas educacionais para além da tradicional análise das prestações de contas? E de que maneira essa atuação tem se configurado como uma nova agenda de controle da administração pública na área da educação? O referencial teórico mobilizado baseia-se na concepção de que mecanismos de controle são constitutivos de Estados democráticos (O’Donnell, 1998). Assim, não se trata de negar a realização de controle, mas problematizar o modo como vem sendo reorganizado no campo da política educacional. Nesse sentido, o conceito de accountability oferece um eixo interpretativo central ao enfatizar a responsividade governamental como dimensão estruturante da democracia, situando os TC dentro de um sistema mais amplo de controle democrático (O’Donnell, 1988; Arantes et al., 2010; Machado, 2012; Morais; Bonfim, 2016; Smulovitz; Peruzzotti, 2000). Discutem-se, ainda, aspectos institucionais dos TC, como funções, estrutura organizacional e formas de atuação, a fim de construir subsídios para compreender sua atuação na política educacional, bem como o papel de instituições associativas na conformação de uma agenda nacional de atuação por meio de publicações orientativas e indutivas. A análise das menções de ações localizadas nos portais eletrônicos dos TC, no período anterior e posterior à aprovação do Plano Nacional de Educação (2014-2024), confirma a hipótese de ampliação da atuação do órgão no campo educacional, ainda que com diferentes graus de engajamento. Também se evidencia um movimento de reorganização institucional, materializado na criação de departamentos específicos voltados à temática educacional, revelando a progressiva consolidação de uma agenda de controle na área. Com base nesse panorama, adotou-se um recorte que delimita as análises às auditorias operacionais programáticas com relatórios disponíveis nos portais eletrônicos, por apresentarem maior grau de sistematização, documentação e vinculação a iniciativas articuladas. A análise desse grupo de auditorias revela mudanças substantivas no escopo, na profundidade e no modo de atuação dos TC na política educacional, evidenciando a expansão da agenda fiscalizatória, tanto pela diversidade temática contemplada, que abrange desde infraestrutura, planejamento e gestão, até elementos pedagógicos e de formação docente, quanto pela natureza dos procedimentos metodológicos mobilizados, cada vez mais apoiados em técnicas de observação direta, triangulação de dados e uso de referências externas. Identifica-se, ainda, a presença de princípios típicos da lógica gerencial, voltados à eficiência, mensuração de resultados e monitoramento de desempenho. Por fim, reconhece-se a necessidade de estudos que aprofundem e ampliem a análise desse fenômeno, considerando sujeitos centrais do processo, como os gestores públicos, auditores e conselheiros do TC, de modo a compreender os efeitos desse novo padrão de atuação sobre a formulação, implementação e avaliação das políticas educacionais, bem como sobre a garantia do direito à educação

Abstract: This thesis aims to map the performance of the State and Federal District Audit Courts (TC in its Portuguese acronym) in controlling educational policy and to analyze their practices in the constitution of a new agenda for action in the area. Thereunto, it conducts qualitative research, of an exploratory and documentary nature, with complementary use of quantification strategies for data presentation. It starts with the following problem: what practices have been developed by the State and Federal District Audit Courts in controlling educational policies beyond the traditional analysis of accountability reports? And how has this action been configured as a new agenda for controlling public administration in the education area? Theoretical framework employed is based on the conception that control mechanisms are constitutive of democratic states (O’Donnell, 1998). Thus, it is not a matter of denying the existence of control but problematizing the way in which it has been reorganized in the field of educational policy. In that regard, the concept of accountability offers a central interpretative axis by emphasizing governmental responsiveness as a structuring dimension of democracy, situating the TC (presumably referring to a specific educational institution or body) within a broader system of democratic control (O’Donnell, 1988; Arantes et al., 2010; Machado, 2012; Morais; Bonfim, 2016; Smulovitz; Peruzzotti, 2000). Furthermore, institutional aspects of TC are discussed, such as functions, organizational structure, and forms of action to build subsidies for understanding their role in educational policy, as well as the role of associative institutions in shaping a national agenda for action through guiding and inductive publications. The analysis of mentions of actions found on the electronic portals of the Courts of Accounts, in the period before and after the approval of the National Education Plan (2014-2024), confirms the hypothesis of an expansion of the body’s activities in the educational field, albeit with varying degrees of engagement. An institutional reorganization is also evident, materialized in the creation of specific departments focused on educational issues, revealing the progressive consolidation of a control agenda in this area. Based on this panorama, a focus was adopted that limits the analysis to programmatic operational audits with reports available on the electronic portals, as they present a higher degree of systematization, documentation, and linkage to coordinated initiatives. The analysis of this group of audits reveals substantial changes in the scope, depth, and mode of operation of the Courts of Auditors in educational policy, highlighting the expansion of the oversight agenda, both in terms of thematic diversity covered, ranging from infrastructure, planning, and management to pedagogical elements and teacher training, and in the nature of the methodological procedures employed, increasingly supported by techniques of direct observation, data triangulation, and the use of external references. In addition, the presence of principles typical of managerial logic, focused on efficiency, results measurement, and performance monitoring are identified. Finally, the need for studies that deepen and broaden the analysis of this phenomenon is recognized, considering central actors in the process, such as public managers, auditors, and members of the Courts of Auditors, in order to understand the effects of this new pattern of operation on the formulation, implementation, and evaluation of educational policies, as well as on guaranteeing the right to education
