A constituição orgânica em Hegel : o destino natural nas linhas fundamentais da filosofia do direito

Abstract

Resumo: Nas Linhas Fundamentais da Filosofia do Direito, Hegel, nas passagens em que dá consistência filosófica à eticidade, irá adjetivar a constituição política e o funcionamento do Estado como orgânicos. A ideia de Estado-Organismo irá então definir toda sua empreitada de definição da vida ética, em que a tessitura institucional, em todas suas partes, é vinculada a um todo, que opera como substrato racional. Não obstante, a ideia de organismo, como superação de um modelo mecânico de se tratar do fenômeno político, se afigura como uma forte metáfora natural. Ainda, observa-se que a rede institucional da eticidade não só se forma através da constituição de segundas naturezas (hábitos e costumes), mas que a ideia de natureza é posta por Hegel como curiosa justificativa para diversas posições sociais, como os diferentes papéis de gênero, as heranças, o colonialismo e o poder do príncipe. Ou seja, na obra política e jurídica hegeliana abundam referências ao natural, incidindo diretamente em como conceber o próprio Estado e a constituição política [Verfassung]. Em razão disso, o presente trabalho possui como objetivo compreender a função (lógica) da natureza nas Linhas Fundamentais da Filosofia do Direito de Hegel, principalmente à luz do pensamento contemporâneo, que se desdobra tanto nas interpretações correntes de Hegel, quanto na filosofia da natureza e da biologia atuais. Logo, a partir da lógica dialético-especulativa reinterpretada por Angelica Nuzzo, a exposição foi feita de forma a explorar sistematicamente o naturalismo ético hegeliano, com enfoque no conceito de organismo, explorando suas dimensões, até se atingir suficiência na exposição para "abrir" o conceito, investigando de forma plástica suas consequências. Assim, seguindo-se à explicação do percurso metodológico, inicialmente, se propôs uma leitura da filosofia do direito hegeliana a partir da ação, o que imbui de caráter trágico a dialética-especulativa, com enfoque na interpretação de Hegel da tragédia da Antígona de Sófocles, na Fenomenologia do Espírito; após, foi buscada uma delimitação dos sentidos de organismo e natureza no seio da eticidade, através da obra Linhas Fundamentais da Filosofia do Direito de Hegel, em que foi especificado que a ação propriamente orgânica, de "fazer-organismo", é ato operativo de mediação, de feitiçaria, onde se engendra as partes no todo; ao fim, foi explorado o conceito de organismo em diálogo espelhado com a Filosofia da Natureza de Hegel, somado à interpretação por meio de debates contemporâneos sobre planetariedade, simbiogênese e Gaia, propondo uma releitura especulativa da eticidade e da constituição orgânica através do conceito de Tribunal do Mundo. O que se encontrou da análise, portanto, é que, ainda que o Espírito objetivo trave luta contínua contra tudo o que é natural, a natureza remanesce como suporte inerradicável da Filosofia do Direito. Ou seja, essa é a tragédia do naturalismo ético: ao fim, a lógica do espírito objetivo possui como destino o natural. Não obstante, contudo, isso não implica em uma limitação, mas em uma possibilidade hermenêutica. Por isso, o trabalho se conclui como convite a interpretar o destino natural de forma produtiva, não como simples erro no modernismo hegeliano, mas como possibilidade de compreender os desdobramentos da modernidade e da liberdade face aos atuais compromissos da filosofia na conceituação da relação entre humanidade e natureza com o advento da crise climática

Abstract: In characterizing his philosophical account of ethical reality in the Outlines of the Philosophy of Right, Hegel conceptualizes both the political constitution and the inner workings of the State as functioning as an organism. The idea of the State as an organism is a defining trait of his entire philosophical project to articulate ethical life, wherein the institutional fabric, in all its constituent parts, is synchronized with an overarching whole, its rational subtract. Nevertheless, the notion of organism, as the philosophical sublation of a mechanical model for understanding political life, is a metaphor deeply imbued with naturalistic undertones. Thus, in his philosophical expositions, it is evident that institutions are constituted in sync with "second natures" (habits and customs), and that the idea of nature is frequently invoked as a primary explanatory source for various social hierarchies—such as differences in gender roles, inheritance, colonialism, and the power of the prince. In other words, references to the natural world abound in Hegel’s juridical and political works, directly impacting his conceptualization of the State and the political constitution [Verfassung]. In light of this, the present work seeks to comprehend the logical function of nature in Hegel’s Outlines of the Philosophy of Right, considering contemporary thought—including both reinterpretations of Hegelian philosophy and works on the philosophy of nature and biology. Following Angelica Nuzzo’s reworking of Hegelian speculative dialectics, this exposition systematically traces the logic of nature in Hegelian thought, with particular focus on the notion of the organism, exploring its many interconnected dimensions until its meaning can be properly unfolded and reformulated, and the consequences of this conceptual plasticity can be explored. Following through a chapterby-chapter methodological overview, initially, it is proposed that Hegel’s Philosophy of Right can be read through a logic of ‘action’, which introduces an inherent tragic character to speculative dialectics—this reading places special emphasis on Hegel’s interpretation of Sophocles’ Antigone in the Phenomenology of Spirit. Subsequently, the contours of the meanings attributed to the terms "organism" and "nature" in the Outlines of the Philosophy of Right are traced, specifying that the characteristic organic "action" is to "make-organism"—that is, the operative, mediative action, or "sorcery," by which the parts are cohered into the whole. Finally, the concept of organism is explored through a dialogue with Hegel’s Philosophy of Nature, an interpretation enriched by contemporary works on planetary thought, symbiogenesis, and Gaia, leading toward a speculative reworking of the concept of ethical order and the organic constitution through Hegel’s formulation of the World Tribunal. These steps culminate in a tragic synthesis, concluding that even if the objective spirit remains in constant struggle with all that is natural, nature persists as an ineradicable structure within Hegel’s philosophy of right. In other words, this is the tragedy of Hegel’s naturalism in the Philosophy of Right: ultimately, nature is the logical destiny of the objective spirit. However, this is not merely a limitation of analysis, but rather a hermeneutic opportunity. Thus, this work concludes with an invitation to interpret such natural destiny productively—not simply as a flaw in Hegel’s modernist project, but as a renewed possibility for understanding the unfolding of modernity and freedom, especially in light of contemporary philosophy’s engagement with the relationship between humanity and nature, particularly in the context of the climate crisis
