Hospitais de custódia e tratamento psiquiátrico : instituições que legitimam o discurso da periculosidade e validam a violência estatal sobre o "criminoso-louco"

Abstract

Resumo: O hospital de custódia e tratamento psiquiátrico é instituição que recebe aqueles sentenciados às medidas de segurança, nos quais em teoria não poderiam receber a sentença de pena comum, já que a eles não se pode atribuir a culpabilidade. Os internos que lá vivem são pessoas ainda mais marginalizadas, em virtude de, além de sofrerem com a hostilidade de terem cometido crimes, são vulneráveis em vista as doenças da mente. O objetivo desse Trabalho de Conclusão de Curso, portanto, é tecer críticas ao sistema que inviabiliza um tratamento psiquiátrico de qualidade nessas instituições, através de estudos e análises de pesquisadores que se dedicaram a examinar esta problemática. Além de buscar apreciar a realidade dos hospitais de custódia, é também intenção desse trabalho apontar os problemas que giram em torno do processo de determinação da medida de segurança. O judiciário brasileiro tem um papel importante nessa subjugação, pois ele é quem estabelece penas sem um limite máximo. Isto significa que, até cessar a periculosidade o juízo não pode determinar o fim da pena, contudo, o conceito de "criminoso-louco" e perigoso ¢ algo muito subjetivo, logo há situações que a medida pode durar 1 ano e em outras a vida toda, já que muitas doenças psiquiátricas não tem cura.

Abstract: The custody and psychiatric treatment hospital is an institution that receives those sentenced to security measures, in which, in theory, they could not receive the common sentence, since guilt cannot be attributed to them. The inmates who live there are even more marginalized people, because, in addition to suffering from the hostility of having committed crimes, they are vulnerable to mental illnesses. The objective of this Course Completion Work, therefore, is to criticize the system that prevents quality psychiatric treatment in these institutions, through studies and analyzes of researchers who have dedicated themselves to examining this problem. In addition to seeking to appreciate the reality of custodial hospitals, it is also the intention of this work to point out the problems that revolve around the process of determining the security measure. The Brazilian judiciary has an important role in this subjugation, as it is the one who establishes penalties without a maximum limit. This means that, until the dangerousness ceases, the court cannot determine the end of the sentence, however, the concept of "crazy-criminal" and dangerous is something very subjective, so there are situations in which the measure can last 1 year and in others the lifetime all, since many psychiatric illnesses have no cure. Does this mean that criminal law allows the inmate to remain in treatment in a custodial hospital forever?
