Resumo: A pesquisa aqui desenvolvida possui como finalidade estudar o processo de recuperação sob a perspectiva da teoria dos processos coletivos. Entende-se que o processo de recuperação recebeu bastante atenção nos últimos anos sob uma perspectiva material, no entanto, em sua vertente processual foi objeto de pouco estudo. Há um modelo processual idealizado pelo legislador e previsto na Lei 11.101/2005, no entanto esse layout é diariamente deturpado pela prática forense. A hipótese do trabalho é verificar se o processo de recuperação judicial pode ser enquadrado na categoria dos processos coletivos para possibilitar a estruturação de um devido processo legal coletivo no processo recuperacional. Com isso, abre-se caminho para o desenvolvimento de ferramentas processuais adequadas a tutelar o direito material na Lei 11.101/2005, sem violar direitos processuais fundamentais. Abstract: The research carried out in this work aims to study the reorganization process from the perspective of the theory of collective processes. It is understood that the reorganization process has received a lot of attention in recent years from a material perspective, however, in its procedural aspect it has been the subject of little study. There is a procedural model idealized by the legislator and provided for in Law 11.101/2005, however, this layout is daily misrepresented by forensic practice. The hypothesis of the work is to verify if the judicial reorganization process can be framed in the category of collective processes to enable the structuring of a due collective legal process in the reorganization process. This opens the way for the development of adequate procedural tools to protect the substantive right in Law 11.101/2005, without violating fundamental procedural rights.
