Desclassificação do delito previsto no art. 217-A para o 215-A do código penal a partir da jurisprudência dos tribunais superiores : análise dos crimes de violência sexual a partir de uma epistemologia feminina

Resumo : O delito de importunação sexual, implementado no Código Penal brasileiro a partir da Lei 13.718/2018, surgiu com o objetivo de oferecer tutela jurídica à prática de ato libidinoso com o objetivo de satisfazer a lasciva própria ou de terceiros, contra alguém e sem sua anuência. Após a integração deste tipo penal ao Código Penalbrasileiro, no art. 215-A, a possibilidade de desclassificação do delito de estupro de vulnerável, previsto no art. 217-A do Código Penal, para o crime de importunação sexual passou a ser debatida. O presente artigo teve por objetivo geral analisar o tema da desclassificação do crime de estupro de vulnerável para o crime de importunação sexual, considerando como categorias de análise os argumentos pró réu e pró vítima decorrentes da possibilidade de desclassificação. O objetivo específico da pesquisa constituiu na análise dos argumentos favoráveis à vítima e ao réu na possibilidade de desclassificação sob a perspectiva de uma epistemologia feminista na análise destes crimes de violência sexual. A metodologia utilizada foi a análise da jurisprudência do Superior Tribunal de Justiça no período de 05/02/2019 a 23/06/2020, através dos termos "estupro prox2 vulnerável e importunação prox2 sexual" no mecanismo de busca deste Tribunal, bem como a análise do julgamento do leading case a respeito deste tema pelo Supremo Tribunal Federal, no âmbito do Habeas Corpus n. 134591. A partir desta análise, observou-se que a Terceira Seção do Superior Tribunal de Justiça consolidou entendimento pela impossibilidade de desclassificação do crime de estupro de vulnerável para o de importunação sexual, destacando-se o posicionamento em sentido contrário do Ministro Reynaldo Soares da Fonseca, que se utilizou de argumentos como a baixa lesividade da conduta praticada contra o vulnerável, quando não há conjunção carnal, por exemplo, para justificar a necessidade de uma redução significativa da pena. Este posicionamento pela impossibilidade de desclassificação também foi observado na Primeira Turma do Supremo Tribunal Federal, com a ressalva dos votos dos Ministros Marco Aurélio e Roberto Barroso, sobjustificativas convergentes com o posicionamento do Ministro Reynaldo Soares da Fonseca. Neste sentido, ponderou-se o significado da adoção de tais posicionamentos para as figuras do réu e da vítima do crime de estupro de vulnerável. Os resultados obtidos com esta análise permitem concluir que a interpretação acerca deste tema parte de uma visão masculina decorrente de uma complexa estrutura patriarcal, a influenciando a análise dos crimes de violência sexual em desfavor da vítima. A adoção do referencial masculino do réu como referencial de lesividade da conduta converge na ideia de que a violação dos corpos dos vulneráveis deve ser suficientemente invasiva com base no que o olhar masculino destes julgadores considera como uma violação, em nítido favorecimento da figura do réu, que se torna o centro da discussão jurídica no crime de estupro de vulnerável. A valoração da lesão ao bem jurídico e a ofensividade da conduta são, nos discursos analisados, medidas em referência ao órgão genital masculino e na extensão de sua participação no ato sexual. A proposta de uma dogmática penal feminista é a análise do significado do crime de estupro à luz do significado do ato para a vítima e de suas consequências, evidenciando a desigualdade social entre os sujeitos masculino e feminino. Neste sentido, o foco de proteção da norma deve ser reorientado na figura da vítima vulnerável, e a lesividade ao bem jurídico deve sempre ser analisada a partir do significado do ato perpetrado ao bem jurídico do futuro desenvolvimento sexual saudável e sem traumas do vulnerável. Abstract: The crime of sexual mischief, implemented in the Brazilian Criminal Code by Law no. 13.718/2018, arose with the aim of offering legal protection to the practice of deviate sexual intercourse with the aim of satisfying its own lewdness or that of third parties, against someone and without their consent. After the integration of this crime definition into the Brazilian Criminal Code, in art. 215-A, the possibility of declassification of the crime of statutory rape, provided for in art. 217-A of the Criminal Code, for the crime of sexual mischief began to be debated. The general objective of this article was to analyze the topic of the declassification of the crime of statutory rape to the crime of sexual mischief, considering as categories of analysis the arguments pro defendant and pro victim arising from the possibility of declassification. The specific objective of the research was the analysis of the arguments in favor of the victim and of the defendant in the possibility of declassification from the perspective of a feminist epistemology in the analysis of these crimes of sexual violence. The methodology used was the analysis of court precedents of the Brazilian Superior Court of Justice in the period from 02/05/2019 to 06/23/2020, through the terms "statutory prox2 rape and sexual prox2mischief"ruling in the leading case on this topic by the Brazilian Supreme Court within the scope of Habeas Corpus no. 134591. Based on this analysis, it was observed that the Third Section of the Brazilian Superior Court of Justice consolidated the understanding of the impossibility of disqualification of statutory rape to sexual mischief, highlighting the opposite positioning of Appelate Judge Reynaldo Soares da Fonseca, who used arguments such as the low damage of the conduct directed against the vulnerable when thereis no sexual intercourse, for example, in order to justify the need for a significant reduction of the sentence. This stance for the impossibility of declassification was also observed in the First Panel of the Brazilian Supreme Court, with the exception of the opinions of Supreme-Court Justices Marco Aurélio and Roberto Barroso, under justifications converging with the opinion of Apellate Judge Reynaldo Soares Da Fonseca. In this regard, the significance of the adoption of such opinions for the defendant and the victim of statutory rape was considered. The results obtained with this analysis allow us to conclude that the interpretation about this theme starts from a male view arising from a complex patriarchal structure, influencing the analysis of crimes of sexual violence to the detriment of the victim. The adoption of the male referential of the defendant as a reference of the harmfulness of the conduct converges on the idea that the violation of the bodies of the vulnerable should be sufficiently invasive based on what the male outlook of these judges considers as a
violation, in clear favor of the figure of the defendant, which becomes the center of the legal discussion in the crime of statutory rape. The valuation of the harm to the legal interest and the offensiveness of the conduct are, in the analyzed discourses, measured in reference to the male genital organ and the extent of its participation in the sexual act. The propositionof a feminist criminal dogmatic is the analysis of the meaning of the crime of rape in the light of the meaning of the act for the victim and its consequences, evidencing the social inequality between the male and female subjects. In this regard, the focus of protection of the rule should be reoriented in the figure of the vulnerable victim, and the harmfulness to the legal interest should always be analyzed from the meaning of the act perpetrated to the legal interest of the future healthy and trauma-free sexual development of the vulnerable.
