A introdução das normativas internacionais antiterror na legislação interna e o estímulo à supressão de garantias

Resumo : O artigo tem como objetivo analisar se, apesar da consolidação de um robusto sistema de garantias penais internacionais, sobretudo após o advento da Declaração Universal de Direitos Humanos, a pretensão de repressão de crimes considerados internacionais, notadamente do terrorismo, proporcionou a criação de documentos internacionais que, sob a justificativa de proteção dos valores fundamentais da humanidade, relegam garantias, permitindo a restrição de direitos humanos em determinadas situações. Para tanto, além da pesquisa bibliográfica, realiza-se uma análise qualitativa das Convenções internacionais que tratam do terrorismo, no intuito de verificar as possíveis restrições a garantias penais em seus dispositivos. Posteriormente, é analisado se, ao incorporar os preceitos internacionais em sua legislação interna, o Brasil os adequou aos direitos humanos ou autorizou a limitação de garantias, a partir do exame da Lei nº 13.260/2016 – Lei Antiterror Brasileira. Ao final, pretende-se demonstrar que os dispositivos abertos das Convenções internacionais antiterror contribuem para que os países promulguem leis que colidem com as garantias penais, importando relevante restrição de direitos, e fazendo com que atuem em desacordo com osprincípios constitucionais e direitos humanos. Abstract: The purpose of this article is analyze if, despite the consolidation of a strong system of international criminal guarantees, especially after the advent of the Universal Declaration of Human Rights, the intention of repression of crimes considered international, primarily the terrorism, provided the creation of international documents that, under justification of necessity to protect the fundamental values of the humanity, relegate guarantees, allowing the restriction of human rights in certain situations. Therefore, beyond the bibliographic research, it is done a qualitative analysis of the international conventions about terrorism, in order to verify possible restrictions of criminal guarantees in its norms. After, it is analyzed if when Brazil incorporated the international rules in its legislation, the country has adapted them to human rights or has authorized the limitation of guarantees, examining the Law nº 13.260/2016 – Brazilian Anti-terrorism Law. At the end, the article intends to demonstrate that the open norms of the anti-terrorism international conventions contribute for the promulgation of laws in the countries that collide to criminal guarantees, culminating relevant restriction of rights and making the countries act in disagreement with constitutional principles and human rights.
