Vedações à publicidade médica : contraste entre a realidade jurídico-social e as normas do Conselho Federal de Medicina

Resumo : Através da análise do entendimento jurídico sobre a prestação de serviços médicos, confrontada com a posição do Conselho Federal de Medicina, pretende-se demonstrar a disparidade de tratamento dispensada a essas relações, concluindo que é um vínculo abrangido pelos dispositivos do Código de Defesa do Consumidor. Nesse contexto, são trazidas as resoluções do órgão representante da classe médica sobre publicidade – negacionista no que tange à admissão de haver uma relação de consumo nesses serviços de saúde – incisivamente contrárias à postagem de imagens de resultados de paciente como divulgação de um serviço. Pelas resoluções e manifestações expostas, depreende-se que a justificativa para
tais vedações é pautada na tentativa de coibir um entendimento jurídico sobre a garantia de resultado e de reprimir condutas condizentes com sensacionalismo, mercantilização, concorrência desleal e autopromoção. Por meio da jurisprudência e do exame dos perfis nas redes sociais dos médicos com atuação estética, observase que essa fundamentação não encontra amparo nas transformações vivenciadas nos últimos anos, inclusive quando em comparação aos avanços, nesse quesito, em outras áreas da saúde. Dessa maneira, é analisada a posição do Conselho Federal de Odontologia que permitiu a postagem de fotos "antes e depois" mantendo a proibição ao sensacionalismo e à mercantilização corroborando a possibilidade da flexibilização da publicidade, com a manutenção de seus preceitos éticos. Ao final, com os pontos suscitados no artigo, a intenção é refletir sobre a necessidade de reorganização para adequar a ótica do Conselho Federal de Medicina à realidade social e jurídica que o cerca, haja vista sua posição adotada, destoada da demanda social. Abstract: Throughout the analysis of the judicial understanding on the provision of medical services, confronted with the position of the Federal Council of Medicine, it is intended to demonstrate the disparity in the treatment given to these relationships, concluding that it is a bond covered by the provisions of the Consumer Protection Code. In this context, the resolutions of the representative body of the medical class on publicity are brought up – in denial regarding the admission of a consumption relationship in these health services – strongly opposed to the posting of images of patient results as a service advertisement. From the resolutions and manifestations exposed, it appears that the justification for such prohibitions is based on the attempt to restrain a legal understanding of the guarantee of results and to repress conduct consistent with sensationalism, commercialization, unfair competition and selfpromotion. Through the Brazilian jurisprudence and the examination of the profiles on the social networks of doctors with aesthetic performance, it is observed that this foundation does not find support in the transformations experienced in recent years, including when compared to the advances, in this regard, in other areas of health. In this way, the position of the Federal Council of Dentistry that allowed the publication of photos "before and after" is analyzed, keeping the prohibition against sensationalism and commercialization, corroborating the possibility of the advertising's flexibility, with the maintenance of its ethical precepts. In the end, with the points raised in the article, the intention is to reflect on the need for reorganization to adapt the point of view of the Federal Council of Medicine to the social and legal reality that surrounds it, given its adopted position, completely out of touch with social demand.
