A responsabilidade civil dos nosocômios em caso de infecção hospitalar

Abstract

Resumo : O presente trabalho visa abordar a responsabilização civil dos hospitais nos casos relacionados a infecções hospitalares, abordando as diferentes posições doutrinarias já feitas até se chegar ao conceito atualmente adotado. Da mesma forma, buscou-se compreender as teorias consideradas pela jurisprudência ao analisar a responsabilidade dos nosocômios, e as causas de afastamento de responsabilidade acolhidas pelo Superior Tribunal de Justiça. Aborda-se também os deveres dos hospitais previstos em diplomas legais em relação a prevenção e controle das infecções hospitalares. Além disso, procurou-se entender o conceito de defeito na prestação de serviço, na doutrina e na jurisprudência, e a responsabilidade decorrente da falha.

Abstract: This paper aims to address the civil liability of hospitals in cases related to nosocomial infections, addressing the different doctrinal positions already made until reaching the concept currently adopted. Similarly, we sought to understand the theories considered by jurisprudence when analyzing the responsibility of hospitals, and the causes of removal of responsibility accepted by the Superior Court of Justice. It also addresses the duties of hospitals provided for in statutes regarding the prevention and control of nosocomial infections. In addition, we sought to understand the concept of defect in service, doctrine and jurisprudence, and the liability arising from the failure.
