A utilização de drones na investigação criminal : uma análise comparativa entre o sistema jurídico norte americano e o brasileiro

Abstract

Resumo : O objetivo deste trabalho é apontar os possíveis benefícios do uso de Drones na investigação criminal, bem como, os embates acerca de sua limitação legal tanto no sistema jurídico brasileiro quanto no sistema norte americano. Buscou-se analisar o atual uso dos Drones no Brasil e com base em consulta a decisões da Suprema Corte Americana, salientar quais são as questões mais problemáticas até o momento acerca da utilização destes equipamentos na investigação criminal. Até que ponto um Drone pode ser utilizado para sustentar mandados de busca e apreensão sob o paradigma da quarta emenda da constituição americana e uma comparação com o sistema jurídico brasileiro.

Abstract: The aim of this paper is to point out the possible benefits of using Drones in criminal investigation, as well as the clashes about its legal limitation in both the Brazilian and the North American legal systems. We sought to analyze the current use of Drones in Brazil and based on consultation with the decisions of the American Supreme Court, highlighting the most problematic issues so far about the use of this equipment in criminal investigation. To what extent can a Drone be used to support search and seizure warrants under the fourth amendment paradigm of the US Constitution and a comparison with the Brazilian legal system.
