Forma jurídica entre essência e aparência : posição pachukaniana no debate marxista sobre o direito

Abstract

Resumo : A presente monografia tem como objetivo introduzir algumas das principais contribuições da relação entre marxismo e direito ao que podemos chamar de teoria marxista do direito, como crítica ao direito ou crítica do direito. Buscamos assim resgatar as bases da concepção marxiana em termos do método e da teoria, bem como das contribuições de Marx para o debate do direito e seu lugar na concepção marxista do mundo. No debate soviético sobre o direito, a partir das figuras de Stutchka, Pachukanis e Vychinski, principalmente o segundo em razão de ser o reconhecido apogeu da formulação da crítica marxista ao direito, formulamos linhas gerais de suas compreensões. Nesse sentido aprofundamos na definição da forma jurídica e seus desdobramentos pelos referenciais intelectuais adotados, abertamente as noções de formas jurídicas aparentes e forma jurídica essencial.

Abstract: This undergraduate thesis aims to introduce some of the major contributions of the relation between marxism and law, to what we may call the marxist theory of law, as a critique of law or a critique about the law. We thus seek to recover the foundations of the marxian conception in terms of method and theory, as well as of Marx's contributions to the debate of law and its place in the marxist conception of the world. In the soviet debate on law, in the figures of Stutchka, Pachukanis, and Vychinski, especially the second one, because it is the acknowledged heyday of the formulation of marxist critique of law, we have outlined its general lines. On this, we rely on the definition of the legal form and its consequences by the adopted intellectual references, blatantly the notions of apparent legal form and essential legal form and apparent legal forms.
