Processos estruturais na Suprema Corte : possibilidades e desafios

Abstract

Resumo : O presente artigo tem como objetivo a análise da capacidade de determinadas ações judiciais submetidas ao STF comportarem decisões estruturais. Identificou-se o conceito e origem do termo structural injunctions ("decisões estruturais") na doutrina norte-americana e como ela pode refletir no direito brasileiro. Em seguida, verificaram-se quais os critérios, condições e desafios para aplicação da reforma estrutural no sistema legal brasileiro. Por último, o estudo aborda como essa forma de juízo pode e deve refletir na atuação do STF, considerando que as causas a ele sujeitas possuem características de tutela coletiva.

Abstract: The present article aims to analyze the capacity of certain Lawsuits submitted to the Supremo Tribunal Federal' (STF) are compatible with structural injunctions. It was identified the concept of the structural injunctions in American doctrine and how it may reflect in the brazilian jurisdiction. Then, it was found what are the standard and conditions for applying the structural reform in the brazilian legal system. Finally, the method addresses how this new form of adjudication can and should be used by the brazilian Supreme Court, considering that the demmands subject to it have the characteristics of class actions.
