Transferência de políticas de proteção de dados : o caso da Lei Geral de Proteção de Dados e do General Data Protection Regulation

Abstract

Resumo: O grande fluxo e compartilhamento de informações possibilitou que Estados e organizações supranacionais dessem atenção a proteção de dados e formulassem normativas referentes a temática. Após aprovação do General Data Protection Regulation (GDPR) pela União Europeia, é observado um esforço do Brasil em tratar dos projetos de lei de proteção de dados existentes no Congresso Nacional, além de adequar o regulamento à normativa europeia. A partir dessa problemática, a presente pesquisa propõe responder a seguinte pergunta: como é realizado o processo de transferência do GDPR para o Brasil? Assim, tendo como base o modelo de análise de transferência de políticas públicas, a dissertação estuda o processo de transferência do General Data Protection pelo Governo Brasileiro, resultando na Lei Geral de Proteção de Dados. Para tanto, a pesquisa estabeleceu um panorama sobre a evolução política do tema de proteção de dados e analisou o processo de formulação da Lei Geral de Proteção de Dados Pessoais, evidenciando suas relações com a União Europeia. Os resultados confirmam a transferência do regulamento europeu pelo governo brasileiro, bem como a inspiração em ideias e instrumentos adotados pela normativa em matéria de proteção de dados.

Abstract: The large flow and sharing of information made it possible for States and supranational organizations to pay attention to data protection and formulate regulations on the subject. After the approval of the General Data Protection Regulation (GDPR) by the European Union, Brazil has made an effort to deal with the data protection bills existing in the National Congress, and in addition, adapt the regulation to European normatives. Based on this issue, this research proposes to answer the following question: how is carried out the transfer process of GDPR to Brazil? Thus, based on the public policy transfer analysis model, this dissertation studies the process of transfer of General Data Protection by the Brazilian Government, resulting in the General Data Protection Law. To this end, this research established an overview of the political evolution of the data protection theme and analyzed the process of formulating the General Personal Data Protection Law, highlighting its relations with the European Union. The results confirm the transfer of the European regulation by the Brazilian government, as well as the inspiration in ideas and instruments adopted by the legislation on data protection.
