Abstract

Resumo : Dentre os princípios fundamentais constitucionalmente garantidos, importa para o presente estudo teórico, principalmente, o princípio da liberdade de religião, presente na Constituição de 1988 e estando previsto em seu art. 5º, inciso VI. Esta monografia tem por objetivo traçar considerações sobre referido princípio, o que garante a todos o Estado laico, e sua relação com a política. Assim, primeiramente aborda-se a relação do direito a liberdade, uma das principais garantias dada constitucionalmente a todos, com o direito a igualdade e a democracia, uma vez que não há como se falar em liberdade na ausência de igualdade, e de modo que a democracia só pode ser visualizada onde tais direitos sejam garantidos. Ademais, abordar-se-á mais profundamente a questão da liberdade de religião e o denominado Estado laico, expondo suas formas de expressão constitucionalmente garantidas e a evolução de tal garantia dentro das Constituições já existentes no Brasil, questionando a presença dos símbolos religiosos em locais públicos, tais como os tribunais e as instituições de ensino. Após, será explanado o fato que, apesar de ser o Estado laico um direito fundamental, não se trata, como qualquer outro direito, de um direito absoluto, admitindo restrições em casos excepcionais. Para finalizar o presente estudo, abordar-se-á a questão dos conflitos entre o Estado laico e algumas políticas públicas, discorrendo acerca das discussões existentes entre grupos cristãos e laicos acerca do lugar e do papel da religião e de certos direitos humanos e sociais, principalmente no que diz respeito às minorias, objetivando verificar se o Brasil atualmente é efetivamente um país de esfera pública laicizada.

Abstract : Among the constitutionally granted fundamental principles, the one that matters for the current theoretical study is, chiefly, the principle of freedom of religion, existing in the Constitution of 1988 and being foreseen in its Article 5, Clause VI. This paper has as its main objective the making of some considerations about the aforementioned principle, which grants to all a secular State, and its relation to politics. Therefore, firstly the relation of right of freedom is approached, one of the main guarantees that is given to us by constitutional means, with the right to equality and to democracy, since there's no talking about freedom in the absence of equality, and seeing that democracy can only be seen where such rights are granted. Moreover, the issue of freedom of religion and the so-called secular state will be more profoundly discussed, presenting its constitutionally granted form of expression and the evolution of such guarantees inside the already existing Constitutions in Brazil, questioning the presence of religious symbols in public sites, such as Courts and educational facilities. Then, a clarification will be made about the fact that, even though the secular State is a fundamental right, it is not a case, as any other right, of an absolute right, allowing reservations in exceptional cases. To conclude this paper, the conflict between the secular State and some public policies will be broached, expatiating about the already existing discussions between christians and areligious people about the place and the role of religion and of certain human and social rights, chiefly concerning minorities, aiming at verifying if at the moment Brazil is, effectively, a country with a secular public sphere.
