Judicialização da educação especial : análise das decisões do Tribunal de Justiça do Paraná (1995-2018)

Abstract

Resumo : O reconhecimento da educação como um dever do Estado e da cognição de um direito público subjetivo através da Constituição Federal de 1988, bem como, da ratificação de tratados internacionais e da criação de leis que tutelam esse direito, gerou ao sistema de justiça brasileiro uma presença mais atuante no que tange o direito à educação. O presente trabalho busca compreender o comportamento do Tribunal de Justiça do Estado do Paraná (TJ-PR) entre os anos de 1995 e 2018 e analisar causas que foram apreciadas sob o tema modalidade educação especial. Para tanto, foi feito um estudo teórico em referência ao direito à educação, educação especial e judicialização da educação. O propósito é analisar esse contexto que envolve a comunidade escolar e o Poder Judiciário; Para isso, foram feitas coletas de jurisprudências que foram objeto de análise pelo TJ-PR. Através do sitio eletrônico do próprio Tribunal foram feitas pesquisas jurisprudenciais, utilizando-se o descritor "educação especial" para coletar os dados referentes ao ano de 2015 a 2018 e, para agregar o conteúdo, foi utilizado o conteúdo da pesquisa de SILVEIRA (2015) no qual foi coletado as informações que abrangem o período entre os anos de 1995 a 2013. A partir dos dados obtidos, foi possível identificar que apenas em 2012 houve o primeiro registro de um acórdão em que o TJ-PR analisou o tema, mas desde então essa atuação tem se feito mais constante por meio das ações que vem sendo encaminhadas ao conhecimento do respectivo Tribunal, haja vista, as diversas matérias que cercam a temática e que influenciam diretamente a vida dos educandos com deficiência.

Abstract : The recognition of education as a duty of the State and the cognition of a subjective public right through the Federal Constitution of 1988, as well as the ratification of international treaties and the creation of laws that protect this right, more active in what concerns the right to education. The present work seeks to understand the behavior of the Court of Justice of the State of Paraná (TJ-PR) between the years 1995 and 2018 and to analyze causes that were appreciated under the theme special education modality. For that, a theoretical study was made regarding the right to education, special education and judicialization of education. The purpose is to analyze this context that involves the school community and the Judiciary; For this purpose, collections of jurisprudence were collected and analyzed by the TJ-PR. Through the website of the Court itself, jurisprudential research was done, using the descriptor "special education" to collect the data for the year 2015 to 2018, and to aggregate the content, the content of SILVEIRA's research (2015) was used, in which the information covering the period from 1995 to 2013 was collected. From the data obtained, it was possible to identify that only in 2012 was the first record of a judgment in which the TJ-PR analyzed the subject, but since then this action has become more constant through the actions that have been sent to the knowledge of the respective Court, given the various subjects surrounding the issue and that directly influence the lives of students with disabilities.
