Resumo : Essa pesquisa tem como objeto de estudo a gestão democrática na educação pública, através da legislação nacional, estadual e principalmente a municipal (Curitiba). A partir de 1988, com a Constituição Federal, a educação teve como um de seus princípios a gestão democrática do ensino. Após a efetivação da Carta Magna, outras leis específicas na educação foram criadas para regulamentar e trazer para a prática a legislação vigente, reforçando sempre o princípio da gestão democrática de ensino. O conceito de gestão democrática, como realização de ações coletivas para o bem comum dentro da unidade educacional, foi se tornando aplicável e comum com o passar dos anos. Como forma de exercer a gestão democrática do ensino, foram criados diversos mecanismos que auxiliaram para acontecer esse processo, como o conselho de escola, o conselho de classe, o grêmio estudantil, a associação de pais, o projeto político pedagógico, entre outros. O dirigente escolar, que tem como função coordenar o processo políticopedagógico-administrativo de acordo com a legislação, precisa articular a gestão democrática dentro da escola, fazendo com que todos os segmentos ali presentes se envolvam e participem das demandas da unidade. A forma de provimento ao cargo de diretor escolar pode ser diferente, dependendo da legislação local vigente, podendo ser por indicação, concurso público, de forma mista e por eleição. Em Curitiba, como local de estudo, baseando-se em leis que especificam o cargo de diretor escolar, identificou-se que a eleição de diretores das escolas municipais já acontecia antes mesmo da promulgação da Constituição Federal. Um grande processo de evolução e mudanças legislativas ocorreu desde a primeira Lei específica, de 1983, que estabeleceu o cargo de diretor escolar, até a legislação em vigor. Enfatizando que, a forma da escolha do diretor escolar é tão importante como suas ações democráticas dentro da escola. Abstract : This research has as its object of study the democratic management in public education, through national legislation, state and especially the municipal (Curitiba). From 1988, with the Federal Constitution, education had as one of its principles to democratic management of education. After the realization of the Magna Carta, other specific laws in education were created to regulate and bring to practice the existing legislation, strengthening the principle of democratic management of education. The concept of democratic management, as realization of collective actions for the common good within the educational unit, was becoming applicable and common with the passing of years.As a way of exercising democratic management of teaching, various mechanisms have been created that helped to happen this process, such as the Council of the school, the class council, the student, the guild parents association, the political pedagogical project, among others.The chairperson at school, which has the function of coordinating the political-pedagogical processadministrative according to legislation, need to articulate the democratic management within the school, making all segments there present involved and participate of the demands of the unit. The form of provision school director may be different, depending on local legislation, may be an indication, public tender, of mixed form and by election. In Curitiba, as the place of study, based on laws that specify the position of director at school, it was identified that the election of Executive Directors of the municipal schools have already happened even before the promulgation of the Federal Constitution. A great process of evolution and legislative changes occurred since the first specific Law of 1983, which established the post of director at school, up to the legislation in force. Emphasizing that the form of the choice of school director is as important as its democratic actions within the school.
