Mudanças legais, estratégias financeiras : o comportamento das instituições bancárias à luz das decisões judiciais, sua relevância evolutiva nos tribunais e na duração dos litígios

Abstract

Resumo: O presente trabalho teve como objetivo central investigar os efeitos da Súmula 472 do Superior Tribunal de Justiça (STJ) nas práticas contratuais envolvendo a comissão de permanência no sistema financeiro. O método empregado foi a jurimetria, com dados judiciais extraídos do STJ e do Tribunal de Justiça do Paraná (TJPR), abrangendo o período de 2009 a 2023. A questão de pesquisa foi definida como "A Súmula 472 do STJ, referente ao tema Comissão de Permanência, demonstrou eficácia em promover a adequação das operações das Instituições Financeiras, em reduzir a discussão judicial sobre o tema e em diminuir a duração dos recursos interpostos sobre o tema?". Observou-se que as instituições bancárias reagiram às decisões judiciais sobre a comissão de permanência, quando analisados os resultados das decisões dos anos de 2009 (antes da consolidação do tema) e períodos posteriores. Notou-se grande aumento (23,3% para 76,9%, comparando-se 2009 com 2018) dos casos em que as casas bancárias deixaram de incluir a cláusula de comissão de permanência nos contratos ou, quando prevista, não realizaram a cobrança de forma cumulada com outros encargos no período de inadimplemento. A análise da quantidade de ações sobre o tema revelou uma forte elevação da litigância nos anos e logo após a consolidação do tema discutido, seguidos por período de forte redução, tanto no STJ como no TJPR. Por fim, a pesquisa não validou a premissa de que o tempo de duração dos litígios remanescentes teria diminuído, com a verificação de um cenário de forte instabilidade e picos

Abstract: The central objective of the present study was to investigate the effects of Precedent 472 (Súmula 472) of the Superior Court of Justice (STJ) on contractual practices involving the "comissão de permanência" (late payment commission/fee) in the financial system. The method employed was jurimetrics (legal metrics), using judicial data extracted from the STJ and the Court of Justice of Paraná (TJPR), covering the period from 2009 to 2023. The research question was defined as: "Has STJ Precedent 472, regarding the topic of the Late Payment Commission, proven effective in promoting the adjustment of Financial Institutions' operations, in reducing judicial discussion on the topic, and in decreasing the duration of appeals filed on the topic?". It was observed that banking institutions reacted to judicial decisions concerning the late payment commission when analyzing the results of the decisions from 2009 (before the consolidation of the topic) and subsequent periods. A significant increase was noted (23.3% to 76.9%, comparing 2009 with 2018) in cases where the banks ceased to include the late payment commission clause in contracts or, when provided for, did not charge it cumulatively with other charges during the period of default. The analysis of the number of lawsuits on the topic revealed a sharp rise in litigation in the years during and immediately following the consolidation of the discussed topic, followed by a period of sharp reduction, both in the STJ and the TJPR. Finally, the research did not validate the premise that the duration of the remaining disputes would have decreased, finding a scenario of strong instability and peaks
