    Abstract
    Resumo: Este estudo buscou analisar a ascensão da juristocracia, salientando a possível concentração de poder na Suprema Corte à luz dos princípios de justiça do pensamento tomista e das críticas de Finnis à teoria de Dworkin. Apesar do papel constitucional da Suprema Corte, sua atuação pode refletir arbitrariedade, desafiando a ordem constitucional. Este estudo tem como objetivo geral analisar a lei natural como fundamento para a justiça e o direito, especialmente no que diz respeito à emergência da juristocracia e ao desrespeito aos direitos humanos, comparando a incompatibilidade de aplicação da teoria de Dworkin diante da crítica de Finnis, a luz do pensamento tomista, visando aplicar os princípios da lei natural para promover uma jurisdição mais equitativa e fundamentada em valores éticos universais. Justifica-se pela importância de dar atenção as práticas judiciais que facilitam a concentração de poder, assim como a tomada de decisões que vão de encontro aos princípios democráticos e aos direitos individuais. Sendo assim, o pensamento centrado na justiça e na lei natural desempenha um papel essencial e constante na reflexão filosófica e jurídica ao longo da história. Conclui-se que a Lei natural oferece mecanismos indispensáveis para a manutenção do Estado de Direito. As limitações encontradas incluem a análise centrada no contexto brasileiro e no STF. Recomenda-se uma abordagem comparativa internacional, considerando outras instâncias judiciais e explorando as interações entre aspectos jurídicos, políticos e sociais. Esta pesquisa destaca a necessidade de compreender as complexidades do sistema jurídico em constante evolução, incorporando os princípios de justiça tomistas e as críticas de Finnis à teoria de Dworkin.
     
    Abstract: This study sought to analyze the rise of juristocracy, emphasizing the possibility of concentration of power in the Supreme Court in light of the principles of justice of Thomist thought and Finnis' criticism of Dworkin's theory. In addition to the constitutional role of the Supreme Court, its actions may be reflected in arbitrariness, in disagreement with the constitutional order. This study has the general objective of analyzing justice and natural law as a foundation for law, especially with regard to the emergence of juristocracy and the disrespect for human rights, comparing the incompatibility of the application of Dworkin's theory to Finnis' criticism, a In the light of Thomistic thought, it begins to apply the principles of natural law to promote more equitable competition based on universal ethical values. It is justified by the importance of paying attention to judicial practices that facilitate the concentration of power, as well as decision-making that goes against democratic principles and individual rights. Therefore, thinking centered on justice and natural law plays an essential and constant role in philosophical and legal reflection throughout history. It was concluded that natural law offers indispensable mechanisms for maintaining the rule of law. The limitations found include an analysis focused on no Brazilian context and no STF. An international comparative comparison is recommended, considering other judicial instances and exploring the interactions between legal, political and social aspects. This research highlights the need to understand the complexities of the legal system and its constant evolution, incorporating Finnish Thomistic and critical principles of justice and Dworkin's theory.
