Contra o contrato : como David Hume pode contribuir para uma teoria da justiça hoje

Abstract

Resumo: Na década de 1970, John Rawls elaborou uma influente teoria da justiça, que passou a dominar as discussões posteriores sobre o tema. Entre as principais características desta formulação está a posição original sob o véu da ignorância. Contudo, este artifício metodológico também foi objeto de críticas. Nesta dissertação abordamos três delas, mobilizando as contribuições de Amartya Sen, Carole Pateman e Chantal Mouffe. Visando escapar às objeções formuladas contra Rawls, buscamos uma tradição filosófica alternativa àquela a qual o autor norte-americano se filiou, preponderantemente lockeana e kantiana. Optamos por empreender a reconstrução da crítica do contrato formulada por David Hume, no século XVIII, posto que o filósofo escocês não só reconheceu na posição contratualista de seu tempo problemas semelhantes àqueles apontados em Rawls, como também ofereceu um caminho diferente de origem e legitimação da justiça - desde um senso individual até sua formulação institucional. A gênese da justiça é o fio condutor dos diálogos desenvolvidos ao longo desta pesquisa, que procura recuperar as formulações humeanas e demonstrar seu valor nos debates atuais sobre o tema.

Abstract: During the 1970's, John Rawls formulated an influent theory of justice, that monopolized the discussions about the theme that followed. Amongst the main characteristics of this formulation was the original position under the veil of ignorance. However, this methodological artifice also was the object of criticism. This dissertation explores three of them, mobilizing the contributions of Amartya Sen, Carole Pateman and Chantal Mouffe. Seeing to escape the objections formulated against Rawls, we searched for an alternative philosophical tradition in opposition to that of the north-american author - mainly Lockean and Kantian. We attempted to reconstruct David Hume's critic of the contract formulated in the 18th century because the Scottish philosopher not only recognized in the contractualism of his time problems that were similar to those in Rawls's formulation bur also offered a different path for the origin and legitimacy of justice - from an individual sense to its institutional form. The genesis of justice is the common thread of the dialogs developed along this research that has its main goal to recuperate the humean formulations and demonstrate its value for the contemporary debates.
