Judicialização do acesso a medicamento : perfil em um hospital terciário

Resumo: Introdução: No Brasil, mesmo com a implantação das políticas públicas que facilitam o acesso aos medicamentos, a garantia desse acesso de forma contínua e em quantidade adequada às necessidades da população ainda é um desafio às autoridades públicas. Objetivo: O presente trabalho tem o objetivo de descrever o perfil das demandas judiciais para o fornecimento de medicamentos no Complexo Hospital de Clinicas da Universidade Federal do Paraná. Métodos: Trata-se de um estudo descritivo e retrospectivo, baseando em informações disponíveis na Justiça Federal - Tribunal Regional Federal da 4ª Região e no sistema de controle do hospital, referente a janeiro de 2012 a dezembro de 2020. Resultados: Foram analisadas 277 ações judiciais no período de janeiro de 2012 a dezembro de 2020. Não houve diferença significativa entre sexo dos requeridos e a faixa etária de maior incidência foi entre 53 e 62 anos. As doenças hematológicas foram as mais prevalentes e o diagnóstico mais comum o mieloma múltiplo. Um total de 87,73% das ações foram deferidas no caráter de urgência, e o tempo médio entre o deferimento até a disponibilização do medicamento pela instituição foi de 109 dias. Foram pleiteados 38 diferentes medicamentos, todos devidamente regulamentados, mas não incorporados no SUS. Apenas o bevacizumabe, rituximabe e omalizumabe, apresentaram algumas indicações não regulamentadas em bula. O custo total das demandas foi de R$ 67.945.377,48, sendo o eculizumbe responsável por 37,55% desse valor total. Quanto às fontes de provisão o maior percentual de responsabilidade foi da União. Foi observado excedente de frascos e/ou recursos em 62,45% das demandas onde representando um montante de R$ 14.700.588,62, apenas 19,98% desse foram remanejados com autorização da justiça. Conclusão: Os resultados mostram que a maioria das ações foi deferida em caráter de urgência, e todos os fármacos identificados estavam devidamente regulamentados, mas não incorporados no SUS. E os desafios observados neste estudo para melhor fornecimento dos medicamentos foram à diversidade das fontes de provisão pela falta de um sistema integrado de comunicação entre o judiciário e as três esferas de governo compromete o controle de fornecimento, gerando sobras de frascos e/ou recursos, e algumas vezes desperdício e o impasse nos atendimentos das tutelas de emergências em que o gestor deverá atender a demanda em um curto período de tempo, com um orçamento não programado, sem a devida pesquisa de preço de mercado. Abstract: Introduction: Despite the implementation of public policies that promote access to pharmaceuticals in Brazil, ensuring continuous and adequate access that corresponds to the needs of the population remains a challenge for public authorities. Objective: The purpose of this study was to describe the profile of lawsuits for pharmaceutical supply in the Complexo Hospital de Clínicas of the Federal University of Paraná.. Methods: This is a descriptive and retrospective study based on information available in the Federal Court - Federal Justice of the 4th Region and on the hospital's control system from January 2012 to December 2020. Results: 277 lawsuits were examined from January 2012 to December 2020. There was no statistically significant difference between defendants' sex. The age group with the highest incidence was between 53 and 62 years. Hematological diseases were the most prevalent, and the most frequent diagnosis was multiple myeloma. A total of 87.73% of the lawsuits were granted on na expedited basis, with an average of 109 days elapsed between the approval and the pharmaceutical being made available by the institution. Thirty-eight distinct pharmaceuticals were claimed, all of which were fully regulated, but not included in the Unified Healthcare System. Only bevacizumab, rituximab and omalizumab had some non-regulated indications on the package leaflet. The total cost of the claims was R$ 67,945,337.48 with eculizumab accounting for 37.55% of that total cost. As for the sources of provision, the Federal government had the highest percentage of responsability. A surplus of bottles and/or resources was observed in 62.45% of the demands, totaling R$ 14,700,588.62, and only 19.98% of which werw rearranged with court authorization. Conclusion: The finding show that most lawsuits were granted on an expedited basis, and all pharmaceuticals identified were properly regulated but not included in the Unified Healthcare System. The challenges observed in this study for a greater supply of pharmaceuticals were the diversity of supply sources due to the lack of an integrated communication system between the court and the three levels of government. This affects the supply control, resulting in leftover bottles and/or resources, as well as waste and standoff when dealing with emergency custodies in which the manager must meet the demand in a short period of time, with an unplanned budget, and without a proper market pricing research.
