Regularização fundiária em áreas de preservação permanente no Núcleo Urbano Central da Região Metropolitana de Curitiba (NUC-RMC)

Abstract

Resumo: O enfrentamento da questão habitacional e do déficit de moradias, assim como a ocupação desordenada do espaço urbano em Áreas de Preservação Permanente (APP) são grandes desafios do poder Público. A ineficiência de políticas públicas de habitação somada ao crescimento populacional leva com que famílias sejam obrigadas a construir suas casas de maneira irregular e em áreas de risco, sendo, muitas vezes, localizadas em APPs. Através de reflexões teóricas que abarcam as políticas habitacionais, a situação do déficit no Brasil e na RMC, o debate acerca dos direitos fundamentais à moradia e ao meio ambiente, e da discussão da regularização fundiária, a presente pesquisa busca analisar como as Prefeituras Municipais integrantes do Núcleo Urbano Central da Região Metropolitana de Curitiba (NUC - RMC) trabalham com o assunto da regularização fundiária em seus territórios e, principalmente, a atuação e aplicação de dispositivos legais em processos de regularização em áreas de Preservação Permanente. Abstract: Facing the housing issue and the housing deficit, such as the disordered occupation of urban space in Permanent Preservation Areas (APP), are major challenges for the government. The inefficiency of public housing policies coupled with population growth means that families are forced to build their homes irregularly and in areas at risk, and are often located in APPs. Through theoretical reflections that include as housing policies, a situation of deficit in Brazil and in the MRC, or debate about the fundamental rights in housing and in the environment, and in the discussion of land regularization, a present research research as Integrated Municipal Chambers of the Central Urban Center of the Metropolitan Region of Curitiba (NUC - RMC), which works with land regularization issues in their territories and, mainly, with the application and application of legal provisions in regularization processes in Permanent Preservation areas.
