Impacto do regime tributário sobre a viabilidaqde econômica do cultivo florestal no sul do Brasil

Resumo: O objetivo deste trabalho foi analisar o efeito dos regimes tributários existentes no Brasil sobre a rentabilidade do cultivo florestal de Pinus taeda e suas possibilidades viáveis em seus aspectos de manejo, contábeis e tributários. Os dados silviculturais e econômicos utilizados foram os obtidos em literatura, e complementados com os detalhes de custos associados à parte contábil e tributária, e uma readequação das atividades gerais e de proteção florestal para representar a realidade de pequenos produtores florestais. Foram considerados plantios homogêneos de Pinus taeda com as mesmas condições de implantação e produtividade (1660 árvores com Índice de Sítio (IS) de 22 e um incremento médio anual (IMA) de 36 m³/ha/ano) e submetidos a três tipos de produtores: um como produtor rural enquanto pessoa física proprietário de imóvel rural; outro como produtor rural pessoa jurídica e proprietário de imóvel rural; e o último sem nenhuma forma jurídica, sem a ocorrência do fato gerador, portanto, sem pagamento de impostos. Foram combinados três grupos diferentes de manejo: no primeiro grupo, não há ocorrência de desbastes, apenas corte raso aos 15 anos; no segundo grupo há um desbaste aos oito anos e corte raso aos 18 anos; o terceiro grupo com dois desbastes, um aos oito anos e outro aos 12 anos e corte raso aos 20 anos. Foram consideradas nove escalas de produção de 10 a 50 ha, com variação de 5 em 5 ha, estas submetidas a cinco possibilidades diferentes de tributação: uma sem a incidência de impostos, outra para pessoa física; três regimes tributários para pessoa jurídica e suas possíveis variações, a partir da análise dos fluxos de caixa e dos indicadores de viabilidade econômico-financeira de projetos para empreendimentos florestais. Os melhores retornos econômicos expressam-se nos regimes de manejo com dois desbastes, focados na produção de toras de maior diâmetro, aliados ao regime tributário de pessoa jurídica com lucro presumido no corte raso, em escala de plantio a partir dos 25 hectares. over the profitability of the forest plantation of Pinus taeda and its viable management
possibilities, accounting and tax aspects. The silvicultural and economic data used
were obtained from literature, and complemented with details of costs associated
with accounting and taxation, and a re-adaptation of the general activities and forest
protection to represent the reality of small forest producers. A homogeneous
plantation of Pinus taeda with the same conditions of implantation and productivity
(1660 trees with a Site Index (SI) of 22 and an IMA (Average annual increase) of 36
m³ / ha / year) was considered and submitted to three types of producers, one as a
rural producer being a natural person who owns a rural property, another as a
producer, legal person and a rural property owner, and the other without any legal
form, without the occurrence of the generating event, therefore without payment of
taxes. Three different management groups were combined; in the first group there is
no tree thinning occurrence, only a shallow cut at 15 years; in the second group there
is a thinning at eight years and a shallow cut at 18 years; and the third group with two
thinning, the first at eight years and the second at 12 years and cut at 20 years. Nine
production scales of 10 to 50 ha were considered, varying from 5 to 5 ha, and on
these, five different taxation possibilities were applied, one being tax free, one for
individuals and three tax regimes for legal entities and its possible variations, starting
from the analysis of the cash flows and the indicators of financial economic viability of
projects for forest enterprises. The best economic returns were found in the
management regimes with two thinning, focused on the production of larger diameter
logs, allied to the corporate tax regime with presumed profit in the shallow cut, at a
planting scale of 25 hectares.
