A influência do design da informação e do comportamento informacional na legitimidade dos Tribunais de Justiça Estaduais da região sul

Abstract

Resumo: A presente dissertação considera a convergência entre o Design da Informação e os estudos de comportamento informacional como fatores que influenciam a legitimidade das organizações da justiça, com foco nos Tribunais de Justiça da região Sul do Brasil. O objetivo geral é verificar como o Design da Informação e o comportamento informacional dos usuários impactam a legitimidade organizacional desses tribunais. Os objetivos específicos são: (a) caracterizar a aplicação do Design da Informação nos sites institucionais dos tribunais; (b) descrever o comportamento informacional dos usuários da justiça; (c) analisar prospectivamente a legitimidade das organizações judiciais; e (d) examinar a relação entre Design da Informação, comportamento informacional e legitimidade dos tribunais. A pesquisa é conduzida de forma exploratória, qualitativa e documental, dividida em três fases: (1) análise dos websites dos tribunais da região Sul do Brasil com base no modelo descritivo-normativo criado por Padovani et al. (2009); (2) pesquisa documental sobre o comportamento informacional do usuário, utilizando a análise de conteúdo proposta por Bardin (2016); e (3) análise de estudos empíricos sobre legitimidade e organizações da justiça nas bases Scopus, Scielo, Web of Science e Springer Link, utilizando a revisão sistemática com o método ordinatio proposto por Pagani, Kovaleski e Resende (2015). Os resultados da análise dos websites dos tribunais revelaram o estado atual desses sites e permitiram comparações entre os ambientes selecionados, identificando pontos negativos que podem prejudicar o comportamento de busca do usuário e gerar barreiras ao acesso à informação. A pesquisa documental sobre o comportamento informacional possibilitou identificar diferentes tipos de comportamento dos usuários da justiça, segmentados em usuários externos (advogados e litigantes) e internos (servidores e magistrados); além de três grupos de necessidades informacionais: jurídico-processuais, administrativas e tecnológicas. Também foram identificadas as barreiras pessoais, ambientais e sociais enfrentadas pelos usuários da justiça. A análise dos estudos empíricos permitiu identificar um grupo de pesquisas (grupo C2) na literatura sobre a legitimidade organizacional de tribunais, que se concentra na influência procedimental e processual do judiciário, considerando a teoria da justiça processual. Ao examinar a relação entre Design da Informação, comportamento informacional e legitimidade organizacional dos tribunais, conclui-se que esses fatores podem influenciar negativa ou positivamente a legitimidade. O resultado dependerá do comprometimento das cortes com a justiça processual, incentivando a confiança dos usuários no processo e nos serviços prestados pelas instituições judiciais.

Abstract: This dissertation considers the convergence between Information Design and studies of informational behavior as factors that influence the legitimacy of justice organizations, focusing on the Courts of Justice in the Southern region of Brazil. The overall objective is to examine how Information Design and the informational behavior of users impact the organizational legitimacy of these courts. The specific objectives are: (a) to characterize the application of Information Design on the institutional websites of the courts; (b) to describe the informational behavior of justice system users; (c) to prospectively analyze the legitimacy of judicial organizations; and (d) to examine the relationship between Information Design, informational behavior, and court legitimacy. The research is conducted in an exploratory, qualitative, and documentary manner, divided into three phases: (1) analysis of the websites of courts in the Southern region of Brazil based on the descriptive-normative model created by Padovani et al. (2009); (2) documentary research on user informational behavior, utilizing the content analysis proposed by Bardin (2016); and (3) analysis of empirical studies on legitimacy and justice organizations in Scopus, Scielo, Web of Science, and Springer Link databases, using the systematic review method proposed by Pagani, Kovaleski, and Resende (2015). The results of the analysis of court websites revealed the current state of these sites and enabled comparisons between the selected environments, identifying negative aspects that may hinder user search behavior and create barriers to information access. The documentary research on informational behavior allowed the identification of different types of behavior among justice system users, categorized as external users (lawyers and litigants) and internal users (employees and magistrates). Additionally, three groups of informational needs were identified: legal-procedural needs, administrative needs, and technological needs. Moreover, personal, environmental, and social barriers faced by justice system users were also identified. The analysis of empirical studies allowed the identification of a group of research (group C2) in the literature on the organizational legitimacy of courts, focusing on the procedural and processual influence of the judiciary, considering the theory of procedural justice. By examining the relationship between Information Design, informational behavior, and court legitimacy, it is concluded that these factors can either positively or negatively influence legitimacy. The outcome will depend on the courts' commitment to procedural justice.
