Uma pandemia de ações frívolas? : um estudo sobre a evolução das ações judiciais frívolas, de natureza consumerista, na competência cível, do Tribunal de Justiça do Estado do Paraná, entre os anos 2016-2022

Abstract

Resumo: Pesquisa desenvolvida sob a perspectiva da Análise Econômica do Processo Civil e consubstanciada em dados, com o objetivo analisar o movimento e o contexto de processos frívolos, também conhecidos, no Brasil, por predatórios, em matéria de consumo, no âmbito da competência cível, do Tribunal de Justiça do Estado do Paraná, entre os anos 2016 – 2022. Identificaram-se, inicialmente, em teoria e com modelos econômicos, os incentivos que levam as pessoas a se sujeitarem a disputas judiciais frívolas/predatórias, partindo-se da premissa de que essas pessoas sabem ou têm condições de saber que não possuem razão sobre o conflito. Com base na análise teórica, coletaram-se dados dos sistemas BI Qlik Sense e Projudi, ambos do Tribunal de Justiça do Estado do Paraná, que permitiram o desenvolvimento de testes estatísticos descritivos, bivariados e de modelo logit, contendo informações quantitativas e a contextualização dessas ações. No resultado da pesquisa, constatou-se que houve um aumento proporcional das ações frívolas, em matéria de consumo, na competência cível, nas comarcas do Tribunal de Justiça do Estado do Paraná entre 2016 e 2020, seguido de queda nos anos 2021 e 2022; confirmou-se a hipótese teórica de que as ações judiciais frívolas possuem baixa probabilidade de retorno positivo; identificou-se que houve maior incidência de demandas frívolas em comarcas de entrância inicial, quando comparadas às comarcas intermediárias e finais; e que houve uma forte associação entre frivolidade e o benefício da gratuidade de justiça, no período investigado

Abstract: Research developed under the perspective of the Economic Analysis of Civil Procedure and embodied in data, with the objective of analyzing the movement and context of frivolous litigation, also known, in Brazil, as predatory, in consumer litigation, in the limits of the civil jurisdiction of the Court of Justice of the State of Paraná, between the years 2016 – 2022. Initially, in theory and with economic models, were identified the incentives that lead people to submit to frivolous/predatory litigation, starting from the premise that these people know or are able to know that they have no reason about the conflict. Based on the theoretical analysis, data were collected from the Qlik Sense and Projudi BI systems, both from the Court of Justice of the State of Paraná, which allowed the development of descriptive, bivariate statistical tests and logit model, containing quantitative information and the contextualization of these actions. In the result of the research, was founded that there was a proportional increase in frivolous litigation about consumers in the civil jurisdiction between 2016 and 2020, followed by a decrease in the years 2021 and 2022; the theoretical hypothesis that frivolous lawsuits have a low probability of positive return was confirmed; it was identified that there was a higher incidence of frivolous demands in smalls districts rather then bigger; and that there was a strong association between frivolity and the benefit of free justice, in the period investigated
