"Fica a ré condenada à pena privativa de liberdade" : mulheres criminosas no sistema penitenciário do Paraná, perfil, crimes e cotidiano (2000-2016)

Resumo: Mulheres sempre cometeram e continuam cometendo crimes, indo contra leis e normas socias estabelecidas e consideradas adequadas ao comportamento feminino. Algumas serão investigadas, julgadas e cumprirão a pena privativa de liberdade. Na pesquisa serão expostas as histórias de trinta e cinco mulheres que cometeram crimes e foram condenadas no Estado do Paraná. Essas histórias são fragmentos dos documentos que compõem os prontuários prisionais delas, contando um pouco sobre a vida pregressa e egressa no sistema prisional paranaense. Por meio dos prontuários buscar-se-á responder a seguinte questão: como ocorre a construção da personagem mulher criminosa e encarcerada no Paraná a partir de uma análise dos documentos prisionais compostos por discursos institucionais sobre essas mulheres? Identificando os elementos objetivos e subjetivos que estão presentes nos prontuários prisionais, buscando verificar se há uma norma moral socialmente imposta ao gênero feminino para além da norma legal. Considerando que desde o momento que são identificadas como autoras ou coautoras dos crimes há uma série de discursos jurídicos que são formados sobre elas que violaram o código penal/legal, mas que também violaram o código dos costumes, da moral, dos papéis socialmente construídos ao gênero feminino, papéis que negam a violência e a transgressão e colocam as mulheres como seres dóceis, passivos e subalternos. É necessário considerar essas características "inatas" de feminilidade e também os desvios dessas características que as tornam "perigosas". A metodologia utilizada será a Análise do Discurso, sob a perspectiva de Michel Foucault e Eni Orlandi, dos documentos que compõem os prontuários, pois ao pensarmos no objeto proposto, e nas fontes de pesquisa, elas demonstram o discurso da razão, da verdade, dos operadores do direito e da lei e também o da loucura, da mulher criminosa, acusada e condenada, os fatos são transformados em versões, em um embate de narrativas. Nos prontuários prisionais além das denúncias há ainda informações sobre relações familiares, sociais e econômicas em formulários que as acompanham durante o cumprimento da pena estabelecida. São discursos dos agentes do Estado, de profissionais que trabalharam diretamente com essas mulheres, que as escutaram, interpretaram e colocaram no papel o relato delas, ou seja, há essa intermediação entre elas e o fato narrado, há alguém falando delas ou sobre elas. Abstract: Women have always committed and continue to commit crimes, going against laws and social norms established and considered appropriate for female behavior. Some will be investigated, tried and sentenced to imprisonment. The research will expose the stories of thirty-five women who committed crimes and were convicted in the State of Paraná. These stories are fragments of the documents that make up their prison records, telling a little about their previous and outgoing life in the prison system of Paraná. Through the medical records, an attempt will be made to answer the following question: how is the construction of the character of a criminal and incarcerated woman in Paraná based on an analysis of prison documents composed of institutional discourses about these women? Identifying the objective and subjective elements that are present in prison records, seeking to verify if there is a moral norm socially imposed on the female gender beyond the legal norm. Considering that from the moment they are identified as authors or co-authors of the crimes, there is a series of legal discourses that are formed about them that violated the penal/legal code, but which also violated the code of customs, morals, socially constructed roles around female gender, roles that deny violence and transgression and place women as docile, passive and subordinate beings. It is necessary to consider these "innate" characteristics of femininity and also the deviations from these characteristics that make them "dangerous". The methodology used will be Discourse Analysis, from the perspective of Michel Foucault and Eni Orlandi, of the documents that make up the medical records, because when we think about the proposed object, and the research sources, they demonstrate the discourse of reason, truth, operators of law and the law and also that of madness, of the criminal woman, accused and convicted, the facts are transformed into versions, in a clash of narratives. In prison records, in addition to complaints, there is also information about family, social and economic relationships in forms that accompany them during the fulfillment of the established sentence. These are the speeches of State agents, of professionals who worked directly with these women, who listened to them, interpreted and put their reports on paper, that is, there is this intermediation between them and the narrated fact, there is someone talking about them or about them.
