Análise das ações de uso irregular de software : perfil do demandante, diferenças e similitudes das decisões judiciais

Resumo: Este estudo tem como objetivo geral contrastar as diferenças e similitudes das decisões judiciais de ações em âmbito cível, referente à titularidade do software nos Tribunais de Justiça dos Estados do Paraná, Rio de Janeiro e São Paulo. Realizou-se o recorte temporal que utilizou dados desde 2016 até 2019, intervalo que concentra mais de 50% dos acórdãos em matéria de programa de computador entre 2010 e 2019. A razão de a amostra do estudo considerar os julgados proferidos nos Estados-membros mencionados deu-se em função de tratar-se dos três Estados que mais investem em Ciência e Tecnologia no País. A metodologia utilizada na presente pesquisa possui uma abordagem documental de caráter quantitativo, por meio de método dedutivo, em que se utilizam legislações e decisões judiciais como fontes de dados e, qualitativo que se dá pela análise comparativa dos elementos processuais e das decisões judiciais retiradas da base jurisprudencial dos sistemas de processo eletrônico. Como resultados, tem-se que as maiores demandantes das ações dessa natureza no Brasil são empresas estrangeiras, e a titular que mais requer a tutela jurídica para proteção de seus softwares é a Microsoft Corporation. Conclui-se que os julgados paradigmas, REsp nº 1.403.865/SP e nº 1.185.943/RS, do Superior Tribunal de Justiça (STJ), tornaram-se referências para o embasamento do décuplo do valor do software multiplicado pela quantidade de licenças irregulares, sendo esta a condenação majoritária nos Tribunais analisados. Abstract: This study has the general objective of contrasting the differences and similarities of the judicial decisions of lawsuits in civil area regarding the ownership of the software in the Courts of Justice of the States of Paraná, Rio de Janeiro and São Paulo. The research data time frame was from 2016 to 2019, an interval which concentrates more than 50% of the judgments in the matter of computer programs between 2010 and 2019. The reason for the sample of the study to consider the judgments given in the aforementioned States was due to the fact that these are the three States that most invest in Science and Technology in the country. The methodology used in this research is based on a quantitative documentary approach, through deductive method, using legislation and judicial decisions as data sources. The paper is also based on a qualitative approach, though the comparative analysis of procedural elements and judicial decisions taken from the Courts electronic process systems basis. The work concludes from these main plaintiffs in this nature in Brazil are foreign companies, and the holder who most requires legal protection in order to protect their software ownership is Microsoft Corporation. It is concluded that the paradigms decisions, REsp nº 1.403.865/SP and nº 1.185.943/RS, of the Superior Court of Justice (STJ), became reference to the value parameter, setting as basis ten times the value of the software multiplied by the number of irregular licenses, this being most of the condemnation decisions in the analyzed Courts of Law.
