Promoção da concorrência no sistema financeiro nacional : desafios e panorama regulatório

Resumo: A crise financeira iniciada nos EUA em 2008 gerou impacto em diversas economias mundiais e mostrou o quão danosos são os efeitos desencadeados por estas crises, fato este que corrobora para a necessidade de intervenção regulatória no mercado financeiro, tanto visando mitigar falhas de mercado quanto para amenizar os efeitos que eventuais crises possam ocasionar. A partir de 2008, houve uma mudança na postura de atuação dos reguladores (tornando as regras de atuação mais rígidas para as instituições financeiras) e também houve o surgimento de novos modelos de negócios baseados em tecnologias inovadoras que apareceram não só com a proposta de prover melhores produtos e serviços ao consumidor por meio de soluções tecnológicas e aumentar a competição no mercado financeiro (em especial no setor bancário), mas também trouxeram desafios para a atuação dos reguladores, dada a complexidade e rapidez do desenvolvimento dos negócios emergentes. Neste contexto, o presente trabalho defende a necessidade de promoção da concorrência no sistema financeiro nacional no cenário de concentração bancária, de forma a melhorar o bem-estar dos consumidores. Assim, inicialmente será apresentado o cenário de concentração bancária nacional e as características dos entrantes inovadores do mercado financeiro (fintechs). Em seguida, são apresentados os desafios regulatórios que tangenciam as atividades dessas empresas tecnológicas (exigindo uma abordagem regulatória mais ampla e flexível) e são apresentados casos de desconexão regulatória e de investidas dos bancos contra as fintechs. Por fim, elenca-se os avanços no panorama regulatório e iniciativas que buscam favorecer a promoção da concorrência no sistema financeiro nacional com a finalidade de aumentar o bem-estar do consumidor. Abstract: The financial crisis that started in the USA in 2008 had an impact on several world economies and showed how harmful the effects triggered by these crises are, a fact that corroborates the need for regulatory intervention in the financial market, both to mitigate market failures and to mitigate the effects that any crises may cause. As of 2008, there was a change in the attitude of regulators (making the rules of operation more rigid for financial institutions) and there was also the emergence of new business models based on innovative technologies that appeared not only with the proposal to provide better products and services to consumers through technological solutions and to increase competition in the financial market (especially in the banking sector), but also brought challenges to the performance of regulators, given the complexity and speed of the development of emerging businesses. In this context, the present work defends the need to promote competition in the national financial system in the scenario of banking concentration, in order to improve the well-being of consumers. Thus, initially the scenario of national banking concentration and the characteristics of innovative financial market entrants (fintechs) will be presented. Then, the regulatory challenges that pertain to the activities of these technological companies are presented (requiring a broader and more flexible regulatory approach) and cases of regulatory disconnection and investing of banks against fintechs are presented. Finally, the list of advances in the regulatory landscape and initiatives that seek to favor the promotion of competition in the national financial system in order to increase consumer well-being are listed.
