Comportamento decisório e o perfil do julgador : uma análise dos habeas corpus em tráfico de drogas no TJPR (2013-2016)

Abstract

Resumo: Este trabalho busca investigar em que medida o perfil do decisor afeta o comportamento decisório. Partindo da teoria realista da tomada da decisão judicial, e observando os habeas corpus em matéria de tráfico de drogas julgados pelas câmaras criminais do Tribunal de Justiça do Paraná de 2013 a 2016, fatores externos às regras procedimentais e materiais do Direito serão analisados enquanto variável explicativa. As características sociodemográficas, acadêmicas e de carreira dos indivíduos são os atributos mobilizados na presente investigação, alinhada à corrente sociológica do comportamento judicial. A variância nos votos foi discutida com o auxílio de categorias de decisões e tipos de decisores. Os resultados encontrados demonstram que os julgadores recrutados no Estado, frequentadores das instituições tradicionais da capital, com carreiras monolíticas estão mais inclinados a reproduzir a orientação normativa do tribunal do que colegas de origem regional diversa e trajetórias menos ortodoxas. Juízes substitutos e mulheres, duas minorias no universo da corte, orientam seu comportamento segundo a utilidade reputacional, estando mais vulneráveis a sofrer pressão em sua performance e menos inclinados a divergir da tendência majoritária. Abstract: This paper investigates the extent to which the decision maker's profile affects decision making behavior. Based on the realistic theory of judicial decision-making, and observing the writs of habeas corpus on drug trafficking judged by the criminal courts of the Court of Justice of Paraná from 2013 to 2016, factors external to the Procedural and Substantive Law will be analyzed as an explanatory variable. The social background of individuals was considered through sociodemographic, academic and career characteristics, aligned with the sociological theory of judicial behavior. Variance in votes was discussed with the aid of decision categories and decision makers typologies. The results demonstrate that judges recruited in the state, who attend traditional law schools in the capital, with monolithic or pure careers, are more inclined to replicate the normative orientation of the court. On the other hand, decision-makers of diverse regional backgrounds and less orthodox trajectories can deviate more frequently. The behavior of substitute judges and women, two minorities in the court's universe, can be explained according to reputational utility. They are more vulnerable to suffer pressure on their performance and remotely likely to deviate from the majority vote.
