Ação rescisória por violação de norma jurídica

Abstract

Resumo: O Código de Processo Civil de 2015 passou a prever a violação manifesta de norma jurídica como uma das hipóteses de cabimento de ação rescisória. De acordo com as mais modernas teorias da interpretação, a norma jurídica não está contida no texto legal, mas é dissociada dele. Norma jurídica, para essas teorias, é fruto da construção do direito pelo intérprete, de modo que a violação será sempre de uma das interpretações cabíveis a respeito de um mesmo enunciado legislativo. O Conceito de violação à norma jurídica, portanto, considerada a função atual das Cortes Supremas, diz respeito à violação de uma das interpretações possíveis a respeito de um mesmo enunciado legislativo. Abstract: The Civil Procedure Code 2015 now provides a clear breach of the rule of law as one of the hypotheses of the appropriateness of rescission action.
