Elementos do direito moderno para uma compreensão da organização coletiva do trabalho em cooperativas

Resumo: O presente trabalho pretende resgatar elementos do Direito Modemo que contribuam na compreensão das dificuldades do alcance à cidadania dos trabalhadores coletivamente organizados em cooperativas. A partir das teorias acerca do Estado Modemo, desde o pacto de submissão ao soberano, contrato social visando a vontade geral, comitê de interesses dos negócios da burguesia e meio para uso exclusivo da força, no final do século XIX, o Estado e o Direito se confundem, o primeiro monopólio da produção jurídica o segundo a sua linguagem. Ao mesmo tempo, a Modemidade possibilita o surgimento do modo de produção capitalista. O capitalismo, refletido pelos clássicos da Economia, sob o qual um dos principais teóricos da Revolução Social se debruça, na tentativa de dedicar-se sob um aspecto em especial: a infra-estrutura. Porém, não foi determinado somente pela base material, mas, também pela influência da ética protestante, uma nova ética do trabalho. Na outra margem do oriente, após a colonização e suas conseqüências na desigualdade brasileira, das peculiaridades das formas de .trabalho sob regime de locação, assalariamento em manufaturas, emprego nas Indústrias e grande influência do movimento operário, o capitalismo de Estado varguista organiza as cooperativas sob intervenção federal, iniciando um processo de transformação para um modelo de cooperativismo empresarial. O trabalho assalariado, nas bases do modelo de Estado Social, é regulado limitando os direitos dos trabalhadores as concessões do capitalismo. Aprimoradamente empresarial, o Cooperativismo toma-se um setor econômico, agrário, no advento da Lei 5.764/71, durante o regime militar. Nos anos seguintes, sob a influência da globalização e do neoliberalismo, o emprego entre em severa crise. Já o trabalho cooperado, de raiz operária transformado em cooperativismo empresarial, através dos principios estruturantes de seu sistema, ganha nova interpretação, influenciada por um movimento transformador, dando lugar à outra organização, que vislumbra a possibilidade da emancipação humana, a partir da organização coletiva de trabalho e renda. Assim se dá o Cooperativismo Popular: um socialismo que começa por dentro. Mas precisa garantir a cidadania de seus associados e encontra-se novamente, frente-a-frente com o Estado e o Direito. Abstract: The present work intends to put into perspective elements from the Modem Law that are helpful to the comprehension of the intricacies of the achievement of citizenship by workers collectively organized in cooperatives. Starting from the theories relating to the Estado Modemo (Modem State), the pact of submission to the sovereign, the social contract aiming the general will, the bourgeoisie's comitee of interests and the means to the exclusiveness of the use of the force, by the end of the l9"' century the State and Law are intertwined - the former monopolizes the juridical production, while the latter is its _expression. Meanwhile, Modemity allows the advent of the capitalist production mode. Capitalisrn, viewed through the lens of the Economy classics, was studied by one of the main Social Revolution theorists who intended to focus on one aspect: the infastructure. However, Capitalism was not determined exclusively in materialistic terms, but also by the influence of new work ethics - the Protestant Ethics. In Brazil, after colonization and its consequences for the countries" social inequalities, the work through lease, the paid work in manufacturing companies and in the industry and the influence of the labour movement, Capitalism during President Getúlio Vargas administration organizes cooperatives through federal intervention, which initiates a transformation process leading to an entrepreneurial cooperative model. Paid work based on the Social State model is regulated and limits the worker°s rights regarding capitalist benefits. In the intrepreneurial mode, the cooperative model tums out to be an agrarian economic sector with the Act 5.764/71 of the military regime. Afterwards, employment decreases drastically under the influence of globalization and neo-liberalism. On the other hand, the cooperative work rooted on the Labour Movement transforms itself into an entrepreneurial cooperative model seeking human emancipation through the colective organization of work and income. This is the Popular Cooperative Model: a socialism growing from within its own structure. In the same time, the model seeks citizenship to all its components, and therefore deals directly with the State and Law.
