Os caminhos do constitucionalismo para a democracia

Abstract

Resumo: A presente tese procura analisar o dilema intergeracional que está inscrito no cerne da construção de um Estado Democrático de Direito. Diante disso propõe que a identidade do sujeito constitucional é o resultado da conjunção e do embate entre projetos normativos e temporalidades. Para tanto, examina as múltiplas propostas para o processo de produção da Constituição, bem como os paradoxos derivados da relação entre o direito e a democracia. A tese versa sobre o papel do republicanismo na fundação dos Estados modernos e o funcionamento das instituições. Reflete acerca da identidade do sujeito constitucional, que é considerada como categoria que pode, ao mesmo tempo, mediar as tensões advindas de disputas intergeracionais, e promover a abertura para novas definições da identidade da comunidade política. Indica as aporias provenientes das declarações de direitos e a formação do paradoxo entre constitucionalismo e democracia. Debate as teses envolvendo o poder constituinte e quais os momentos em que o "Nós o Povo" se manifesta. Questiona o projeto liberal a partir de duas vertentes, tanto ao ressaltar os limites de seus institutos fundamentais como ao criticar as renovadas teses que procuram reafirmar tais elementos e revesti-los com novas roupagens. Reflete sobre a ideia da Constituição como um tecido sem costura e as (des)continuidades das narrativas que definem a identidade constitucional. Por fim, procura indicar que existem diferentes caminhos para a definição da relação entre o constitucionalismo e a democracia, porém, nenhum deles pode repudiar a tensão constitutiva entre ambos.

Abstract: This dissertation aims to analyze the intergeracional dilemma that is inscribed in the core of the construction of a democratic Rule of Law. Thus suggests that the identity of the constitutional subject is the result of the conjunction and the clash between normative projects and temporalities. Therefore it examines the multiple schemes of the Constitution-Making process and also deals with the paradoxes derived from the relation between law and democracy. The dissertation addresses the role of republicanism in the founding of modern States and how the institutions work. Reflects about the identity of the constitutional subject, which is considered a category capable of produce the mediation of the tensions derived from the intergeracional disputes and simultaneously, promote the necessary openness to new definitions of the identity of the political community. It indicates the aporias resulted from the declarations of rights and the formation of the paradox between constitutionalism and democracy. It discuss the thesis regarding the constituent power and the moments in which the "We the People" manifests itself. It calls into question the liberal project from two perspectives, in highlighting the boundaries of its fundamental institutes but also in criticizing the renewed thesis that aim to reaffirm such elements by coating them with new clothes. It reflects about the idea of the Constitution as a seamless web and the (dis)continuation of the narratives that define the constitutional identity. Ultimately it states that there are different paths to define the relation between constitutionalism and democracy however, none of them can dismiss the constitutive tension that exist between them.
