    Abstract
    Resumo: A sociedade globalizada impõe ao direito penal a função de evitar riscos econômicos e ambientais de grande magnitude por meio da tipificação de crimes de perigo abstrato. Mesmo nesse contexto, a pena criminal só é legítima quando visa à proteção de bens jurídicos individuais ou coletivos para a manutenção da livre convivência em sociedade. A lavagem de dinheiro configura típica construção legislativa da globalização, pois responde à lógica da internacionalização das normas repressoras, ostenta caráter transnacional, é praticada por autores de difícil identificação e configura um crime de perigo por acumulação que agride um bem jurídico de pouca concretude. Duas conseqüências principais advêm da assunção da lavagem de dinheiro como um delito socioeconômico de perigo por acumulação: a punição do autor do crime antecedente pelo crime consequente, em concurso de delitos, e a ausência de tipicidade de pequenos e isolados atos de ocultação de bens.     Abstract: Present money laundering regulations were set up as typical legal construction of globalization, since (1) they respond to the logic of internationalization of repressive rules, (2) they fundamentally have transnational character, (3) they are perpetrated by authors who are difficult to identify and (4) they configure a crime of danger - by accumulation of crimes - which attacks an abstract legal good. Therefore, two major outcomes derive from the assumption of money laundering as a socioeconomic crime of danger by accumulation: (1) the punishment of the offender of the predicate (previous) crime for the underlying (consequent) crime, and (2) the absence of sanctions for small and isolated acts of concealment of assets.
