Veredicto culpado : a pena de morte enquanto instrumento de regulação social em Castro - PR (1853-1888)

Resumo: Investigar as relações sociais que levaram historicamente os povos a utilizarem a pena de morte, com ênfase no Brasil escravista, mais precisamente na cidade de Castro, Campos Gerais paranaenses, foi o objetivo desta pesquisa. Ao optarmos pela análise da escravidão tomando por ponto de partido a violência cristalizada no assassinato legal de escravos pelo Estado, ilegal, mas aceito, por senhores, ou então, destes por seus escravos, percebemos que havia nestas mortes, mais do que simples crimes. Havia uma lógica de relações sociais, não apreendidas no todo, mesmo com o trabalho em fontes, pois só tornavam-se públicas quando sua manutenção tinha se tornado impossível. Verificando como que a historiografia sobre a escravidão brasileira portou-se perante a questão da violência, fomos identificando como esta percebeu a questão da violência contida nas mortes de senhores ou de escravos, mais precisamente o que nos propusemos fazer foi uma leitura de como a noção e as apreensões dos significados da violência foram sofrendo transformações à medida que os estudos sobre o tema foram se cristalizando. Feito isto partimos então para uma análise de como esta bibliografia com suas contribuições nos permitiriam problematizar um município paranaense colocado nos Campos Gerais. Analisando os processos-crime que tinham escravos, ora como réus, ora como vítimas, tentamos construir um significado para aquelas mortes. Mais do que números nas estatísticas criminais, estas mortes representavam parte de uma dinâmica social que tornava-se conhecida apenas nos tribunais. Além disto, percebemos que a condenação legal ou não de escravos à morte, ou o assassinato de senhores por seus escravos, eram parte de uma tônica social que acabava por confrontar toda a sociedade da época. Os posicionamentos dos indivíduos nos tribunais não eram isentos das relações que eles travavam no seu dia-a-dia, e eles tinham que pesar muito bem isto. O que concluímos com a pesquisa foi que ser condenado à morte naquela época era mais do que apenas descortinar a possibilidade de morrer. Era desnudar relações sociais complexas marcadas pela cotidianidade dos sujeitos históricos, que se não apresentava um contorno sempre claro, tinha os limites de aceitação muito bem definidos. A morte era o preço pago por quem os desconsiderava. Abstract: Investigating the social relations that historically led peoples to use the death penalty, focusing the slavery in Brazil, more precisely in the city of Castro, Campos Gerais in Parana State, was the aim of this paper. When we chose to analyse slavery starting from the unchangeable violence in the legal murder of slaves by the State, illegal, bat accepted, by the masters, on then, from them by their slaves, we noticed that there were more than ordinary crimes associated to their deaths. There was a logic in the social relations, not completely acquired, even with the work on sources, because they became public when its maintenance started to become impossible. Checking how the study of history was developed on Brazilian slavery related to violence, we could identify how the violence found in the deaths of masters and slaves was noticed, more precisely, we proposed a reading on how the notion and the acquisition of meanings from violence changed gradually when the studies about the topic were becoming unchangeable. When this was done, we started an analysis of how this bibliography with its contribution allowed us to think about the problems of Parana Municipal Districit in Campos Gerais. Analyzing the crime processes that the slaves had, sometimes as the accused, sometimes as victims, we tried to build up meanings for those deaths. More than criminal statistic numbers, these deaths represented part of a social dynamic that was know only in the Court. Beside this, we noticed that legal penalty or not for slaves was part of a social system that confronted all the society from that time. The individual opinions in the Courts were not free from relations that they had to deal with day by day, and they also had suffer a lot because of this. To sum up, the paper showed that to be punished to die at that time was more than only showing the possibility of dying. It was really to show all the complex social relations that people had day by day, which sometimes didn.t show a clear confront, there were limits in acceptance defined very well. Death was the price paid for those who didn.t give it its right importance.
