Manipulação genética humana : o controle jurídico da utilização de embriões em pesquisas científicas

Abstract

Resumo: A pesquisa envolvendo a biotecnologia vem sendo alvo de discussões acirradas, porquanto se sabe que os novos conhecimentos produzidos por essa área são passíveis de provocar radicais ransformações no trato do homem com a vida, incluindo aí mudanças de concepção sobre a própria vida humana e adoção de ovas práticas destinadas a preservá-la, prolongá-la ou alterá-la. O interesse coletivo no progresso da ciência médica de um lado e o interesse individual, o respeito à pessoa humana, em seus bens existenciais de vida, dignidade e integridade física etc., de outro, exigem um repensar sobre o uso das modernas tecnologias e uma regulamentação jurídica de seus limites, especialmente em se tratando do embrião humano, dotado de individualidade, autonomia e status jurídico próprio. A tese tem como núcleo central a necessidade de controle jurídico na realização de manipulações genéticas, envolvendo embriões humanos. Para tanto, inicia-se o estudo apresentando a proteção da vida humana pelo direito, as dimensões de direitos e os avanços da ciência genética, para em seguida , tratar da aplicabilidade dos de direitos de personalidade e da dignidade da pessoa humana ao embrião humano. Por fim, procede uma releitura das normas jurídicas pertinentes à manipulação embrionária, apresentando os limites e possibilidades do controle, por meio de instrumentos éticos e jurídicos em construção.

Abstract: The research involving the biological technology is being focus of intransigent discussions, since it is known that the new knowledge produced by that area are susceptible to cause radicals transformations in the man's treatment with life, including change of paradigms about the own human life and adoption of new practices destined to preserve her, to prolong her, to alter her. The collective interest presents in the developing progress of the medical science that exists looking at one side of the question and the individual interest, the respect to the human being, the respect of their individual rights, the respect of their dignity and physical integrity., , demand to rethink about the use of the modern technologies and a juridical regulation to fix secure limits. Especially in the case of the human embryo, provided with individuality , autonomy and its own legal status. The thesis is a core need of legal control in the conduct of genetic engineering involving human embryos. To do so, begins the study by presenting the protection of human life by the law, the dimensions of rights and advances in genetic science, for then, address the applicability of the personal rights and dignity of the human embryo. Finally, proceed to revisit the legal rules relevant to embryo manipulation, showing the limits and possibilities of control through instruments of ethical and legal construction.
