Turismo, direito e democracia : uma análise dos bens democráticos nas leis dos conselhos municipais

Abstract

Resumo: No final do século XX, com a Constituição Federal de 1988, emergiu uma nova configuração do Estado brasileiro pautada na democracia. Em decorrência dessa alteração, foram incorporadas iniciativas de participação, dentre elas os Conselhos Municipais de Políticas Públicas, que concorreram para aumentar a participação democrática nas esferas municipais, inclusive no setor do turismo. Para a análise de ambientes democráticos Graham Smith (2009) articula diferentes visões teóricas, propondo os critérios nomeados de "bens democráticos", quais sejam: inclusão, controle popular, julgamento ponderado e transparência, que representam diferentes aspectos priorizados na promoção da democracia. Partindo de um marco teórico sobre as teorias de democracia, dos bens democráticos e da busca pela democracia na ação pública relacionada ao turismo, o objetivo da presente pesquisa é analisar a democracia nas normas jurídicas que criam e regulamentam os Conselhos Municipais de Turismo em dez capitais brasileiras, sendo duas de cada região do país, que disponibilizam suas normas na internet. As normas que criam e regulamentam os conselhos municipais de turismo são a base da implementação dessas instituições e se não cumprem qualidades democráticas, consequentemente, a efetividade da democracia estará comprometida. A existência de poucas e incipientes pesquisas sobre avaliação democrática no curso das políticas públicas de turismo justificam a importância da presente análise, que busca difundir a aplicação dos critérios estabelecidos por Smith (2009) para futuras pesquisas sobre a regulamentação no âmbito do turismo. Os resultados da análise demonstram que as normas apresentam uma média favorável à diversidade dos membros, predominando o setor empresarial, no entanto, não há considerável representação da sociedade civil. As atribuições específicas dos conselhos, em sua maioria, estão voltadas à pró-atividade, com competências gerais deliberativas. Metade das normas analisadas são favoráveis ao controle popular, porém, a outra metade não apresenta previsões sobre as competências específicas. A maior parte dos conselhos são favoráveis ao julgamento ponderado e a transparência interna, porém desfavoráveis à transparência externa. Conclui-se que essas instituições participativas variam muito em seus desenhos institucionais, o que pode influenciar na adequação dos conselhos aos critérios de participação e democracia. É necessário haver clareza na organização dessas instituições, tanto para seus membros, quanto para a sociedade, sendo imprescindível a adequação das normas que as criam e regulamentam, para possibilitar a democratização da tomada de decisão. Abstract: At the end of the twentieth century, with the Federal Constitution of 1988, a new configuration of the Brazilian state based on democracy emerged. As a result of this change, participation initiatives were incorporated, among them the Municipal Public Policy Councils, which contributed to increase democratic participation in municipal spheres, including in the tourism sector. For the analysis of democratic environments, Graham Smith (2009) articulates different theoretical visions, proposing the criteria named good of democracy institutions: inclusiveness, popular control, pondered judgement, transparency, which represent different aspects prioritized in the promotion of democracy. Leading from a theoretical point about the democracy theories, the democratic goods and the search to democracy in public actions related to tourism, the objective of present research is analyzing democracy on legal rules which create and regulate the Municipal Tourism Councils in ten Brazilian capitals, being two of them from each region of the country, that provide their rules on the internet. The norms that create and regulate the municipal councils of tourism are the base of the implementation of these institutions and if they do not fulfill democratic qualities, consequently, the effectiveness of the democracy will be compromised. The existence of few and incipient research on democratic evaluation in the course of tourism public policies justifies the importance of the present analysis, which seeks to disseminate the application of the criteria established by Smith (2009) for future research on tourism regulation. The results of the analysis demonstrate that the norms present an average favorable to the members diversity, where the business sector predominates, however, there is not a considerable representation of the civil society. The specific assignments of the councils, mostly, are focused on proactivity, with general deliberative competences. Half of the norms that were analyzed are favorable to popular control, but the other half does not present predictions about specific competences. Most part of boards are in favor of judgments and internal transparency, but unfavorable to external transparency. It is concluded that these participatory institutions vary widely in their institutional designs, which may influence the adequacy of the councils to the criteria of participation and democracy. It is necessary to have clarity in the organization of these institutions, both for its members and for society, being essential the adequacy of the norms that create and regulate them, to enable the democratization of decision making.
