O tratamento jurídico das cooperativas de trabalho no Brasil : os desafios da democracia econômica

Abstract

A presente dissertação tem por objeto o tratamento jurídico das Cooperativas de Trabalho no Brasil. O tema é contextualizado nos discursos sobre a crise do paradigma do trabalho no final do século XX e início do século XXI. A análise sócio-econômica da categoria trabalho acompanha a constituição da sociedade salarial sob os aspectos objetivos e subjetivos, demonstrando seus reflexos nas relações sociais. Acompanha os debates ideológicos-políticos contemporâneos e seu reflexo nas várias formas de manifestação do cooperativismo. Analisa criticamente a construção dos princípios cooperativistas, enfatizando a importância das cooperativas de produção em detrimento das cooperativas de consumo. Destaca a construção de cooperativistas populares na realidade brasileira, enfatizando seu potencial como alternativa ao modo de produção vigente, através de práticas autogestionárias. Verifica a discrepância entre estas organizações e o ordenamento jurídico brasileiro. Para tanto, revê o regulamento jurídico do trabalho no Brasil, destacando seus limites, ao disciplinar somente o trabalho subordinado e o trabalho autônomo individual. Refaz a leitura do Direito sobre as Cooperativas de Trabalho, sobretudo, as realizadas pelo Direito do Trabalho, destacando os mecanismos legais e institucionais que tratam a matéria. Constata a ausência legal sobre o tem e analisa os projetos de lei sobre o sistema cooperativistas atualmente tramitando no Congresso Nacional, apontando para suas deficiências. Sinaliza para a necessidade de uma legislação específica sobre Cooperativas de Trabalho que leve em conta suas mudanças e perspectivas atuais, criando condições jurídicas e econômicas para o seu desenvolvimento.

Abstract: The object of this dissertation is the juridical treatment of the Cooperatives of Work in Brazil. Contextualizes the theme in the speeches on the crisis of the paradigm of the work in the end of the century XX and beginning of the century XXI. The socioeconomic analysis of the category work follows the constitution of the salary society under the objective and subjective aspects, demonstrating their reflexes in the social relationships. It follows the contemporary ideological-political debates and their reflex in the several forms of manifestation of the cooperativism. This dissertation critically analyzes the construction of the cooperativists principles, and advocates to the importance of the production cooperatives to the detriment of the consumption cooperatives. It detaches the construction of the denominated popular cooperativists in the Brazilian reality, emphasizing its potential as an altemative to the present way of production, through the economic democracy, that it presupposes, the self-management, the retribution to the accomplished work and the collective property of the production means, inserting them in the new altemative movements to the capitalism. It verifies the discrepancy between these organizations and the Brazilian juridical order. lt detects the limits of the juridical regulation of the work in Brazil, when just disciplining the subordinate work and the individual autonomous work. It redoes the reading of the Right on the Cooperatives of Work, above all, of those made by Right of the Work, detaching the legal and institutional mechanisms that the matter. It verifies the legal absence on the theme and it also analyzes the projects now on the cooperativist system going through the procedure in the National Congress, appearing for their deficiencies. It signals for the need of a specific legislation on Cooperatives of Work that considers the changes and current perspectives, creating juridical and economical conditions for its development.
