Repercussão geral e efeito vinculante : neoconstitucionalismo, Amicus Curiae e a Pluralização do debate

Abstract

Resumo: A tese está assentada na reflexão sobre os limites e possibilidades do efeito vinculante advindo das decisões proferidas pelo STF no controle de constitucionalidade difuso, a partir do julgamento dos recursos extraordinários cujas questões constitucionais subjacentes sejam imbuídas de repercussão geral (CF, art. 102, § 3o). A EC n.° 45/2004 veiculou mecanismo de filtragem, exigindo a comprovação da transcendência da questão constitucional discutida no recurso extraordinário, contribuindo para compatibilização vertical das decisões de instâncias inferiores com os pronunciamentos emanados do STF. A questão central relacionada com o efeito vinculante das decisões proferidas no controle incidental diz respeito à delimitação dos seus "fundamentos (ou motivos) determinantes" (tragende Gründe da Corte Constitucional alemã), de modo que a redefinição do papel do recurso extraordinário coaduna-se com a garantia de participação dos possíveis atingidos pela decisão do Supremo Tribunal Federal. O enfoque é centrado no multifacetário cenário da jurisdição constitucional brasileira, marcada por fortes traços de complexidade e permeada por uma latente conflituosidade e pressão de grupos sociais. Logo, a expansão do efeito vinculante para o controle difuso deve estar atrelada à garantia de ampla participação de amicus curiae como forma de ampliar os horizontes do debate e minimizar o problema atinente ao déficit democrático da jurisdição constitucional.

Abstract: The present study is based on the reflection about the limits and possibilities arising from the binding effect of judgments by the Federal Supreme Court in diffuse constitutional control from the trial of the extraordinary resources which are imbued with constitutional issues underlying the overall repercussions (CF, art. 102, § 3). The Constitutional Amendment n.° 45/2004 defined a filtering mechanism, requiring proof of the transcendence of the constitutional issue discussed in the extraordinary appeal, contributing to vertical compliance of decisions from lower courts with the pronouncements emanating from the Federal Supreme Court. The central issue related to the binding effect of judgments in control incidental concerns the boundaries of their "reasons (or arguments) determinants" (tragende Gründe the German Constitutional Court), so that the redefined role of the extraordinary appeal is consistent, ensuring the participation of the possibly affected by the decision of the Federal Supreme Court, The focus is the multifaceted scenario of Brazilian constitutional jurisdiction, marked by strong features of complexity and permeated by a latent antagonism and pressure from social groups. Therefore, the expansion of the binding effect for the diffuse control must be related to ensure broad participation of amicus curiae as a way to broaden the horizons of debate and minimize the problem regards the democratic deficit of constitutional jurisdiction.
