As regras da justiça no Tratado da Natureza Humana de David Hume

Abstract

Resumo: Este trabalho pretende investigar como se dá a formação de regras gerais no tema da justiça e do governo. Pretendemos mostrar como é a ação de certos princípios sobre a imaginação que tornam esta faculdade ativa e permitem a criação de regras gerais no sistema do conhecimento e, do mesmo modo, no sistema da moral. O trabalho mostra como este expediente permite a Hume se contrapor a Locke e apresentar uma concepção de Direito cambiável, historicamente construído e, ainda assim, capaz de ser explicado pela ação de poucos princípios sobre a imaginação.

Abstract: This writing tries to investigate how general rules are formed in the theme of justice and government. It intends to show how it’s the action of certain principles over the imagination that activate this faculty and allow the creation of general rules in the system of knowledge and, in the same way, in the system of morals. It shows how this allow Hume to stand against Locke and also to present a changeable conception of Law, historically constructed and yet capable of being expressed by the action of few principles over the imagination.
