A significação do real na teoria do direito

Abstract

Resumo: O presente trabalho pretende construir uma visão ontológica do Direito, demonstrando que a preocupação do estágio clássico da teoria do Direito tem uma inclinação de cunho analítico-lingüístico que o afasta da possibilidade de realização essencial e genuína do justo. Pretende, com isso, a demonstração de que o objeto do Direito, sob um ponto de vista ontológico, está na unidade do comportamento humano, a ser compreendido tanto pelo aspecto de um dever ser imperativo quanto pela dimensão das confluências originalmente dadas do comportamento humano.

Abstract: The following work intends to build an ontological perspective of Law and Justice, demonstrating that the concerns originated in the classical cycle of the Law Theory have analytical-lingüistic inclinations that drive it away from the possibility of the essential and authentic accomplishment of justice. Therefore, it intends to demonstrate that the object of Law as science, under an ontological perspective, resides in the unity of human behaviour, to be understood not only as an "ought to be" in imperative form but also as the dimension of confluences originally delivered by human behaviour.
