Supremo constitucional : a guarda da constituição em sentido estrito e os seu adequado módulo processual

Resumo: A presente investigação parte da identificação de lacuna dogmática no Direito Processual Constitucional brasileiro, qual seja, a ausência de compreensão da função expressa de guarda da Constituição atribuída ao Supremo Tribunal Federal pelo Direito Constitucional positivo, que parta de uma metodologia indutiva (dos dispositivos normativos à sua reconstrução teóricodogmática), e não dedutiva (de modelos teóricos, comumente extraíveis do Direito Comparado, ao Direito Constitucional positivo). O trabalho divide-se em duas partes. Na primeira, delineiam-se a insuficiência das respostas dogmáticas hoje predominantes, a insuficiência dos arquétipos de jurisdição constitucional geralmente adotados, os recortes metodológicos necessários para apresentação de uma nova resposta sobre o tema, e a definição dos pressupostos teórico-metodológicos. Na segunda parte, são analisadas, sob lupa, as competências constitucionais do STF, bem como a interpretação da corte sobre a própria competência, de modo a se extrair, em perspectiva crítico-descritiva, a tese, reveladora do sentido constitucional positivo estrito da função de guarda da Constituição. Abstract: The present investigation has its starting point on the identification of a dogmatical gap in the Brazilian Constitutional Procedural Law doctrine, that is, the lack of understanding of the textual function of safeguarding the Constitution attributed to the Federal Supreme Court by the positive Constitutional Law, by an inductive methodology (from the normative provisions to its theoretical-dogmatic reconstruction), and not by a deductive approach (from theoretical models, commonly extracted from the Comparative Constitutional Law, towards the Brazilian constitutional positive norms). The thesis is divided into two parts. In the first, are outlined: the insufficiency of the currently predominant dogmatic answers, the inadequacy of the archetypes of constitutional jurisdiction broadly adopted, the methodological outlines necessary to present a new approach on the subject, and the definition of the baseline theoretical-methodological assumptions. In the second part, the Federal Supreme Court Constitutional power rules are scrutinized, as well as the court's interpretation of its own jurisdiction, in order to extract, in a critical-descriptive perspective, the thesis, revealing a strict normative constitutional meaning of the function of safeguarding the Constitution.
