A legislação e a exploração econômica da reserva legal

Abstract

Resumo: Este trabalho tem como objetivo apresentar a atual legislação florestal e mostrar as dificuldades que os proprietários rurais têm em se adequar às exigências da Lei. bem como também analisar as alternativas de exploração econômica da Reserva Legal Florestal e avaliar as mais diferentes mudanças ocorridas na Legislação Florestal que regem este pequeno e imprescindível espaço de terra que é de suma importância para garantir o equilíbrio do ecossistema. O estudo tem como pressuposto a importância da preservação do melo ambiente, mas considera que a sobrevivência do produtor rural é imprescindível e a legislação florestal deve regulamentar, mas também deve criar condições de exploração econômica e sustentável para o proprietário. A implantação da Reserva Legal Florestal acarreta algumas mudanças no sistema de exploração da terra. porém é necessária para que se possa preservar o meio ambiente garantindo a continuidade da vida terrestre e o equilíbrio do ecossistema. O trabalho aborda a flexibilidade do direito de propriedade diante das diversas mudanças ocorrida na Legislação Florestal destacando os benefícios da implantação da Reserva Legal Florestal e as possibilidades de aproveitamento econômico da área. Numa abordagem geral. discute-se o que vem a ser a Reserva Legal Florestal e enfatiza a situação no Estado do Paraná, apontando algumas formas de se auferir lucro e utilizar este espaço preservado de forma econômica dentro de uma noção de desenvolvimento sustentável.

Abstract: This paper aims to present the current forest legislation and show the difficulties that the landowners have to fit the requirements of the Law, and also analyze the alternatives for economic exploitation of Legal Reserve Forest and evaluate the many different changes in the Forest Law governing this small and vital area of land that is of utmost importance to ensure the balance of the ecosystem. The study has assumed the importance of environmental preservation, but the survival of the farmer is vital to forestry legislation and regulations, but it should also create conditions for sustainable and economic exploitations to the owner. Implementation of Legal Reserve Forest entails some changes in the system of exploitation of the land, but it is necessary to preserve the environment while ensuring the continuity of life and balance of the terrestrial ecosystem. The work addresses the flexibility of ownership in the face of several changes occurred in the Forest Law by highlighting the benefits of deployment of Legal Reserve Forest and the economic possibilities of the area. In a general approach, it discusses what has to be the Legal Reserve Forest and emphasizes the situation in the State of Parana. suggesting some ways to have profits and use this space to preserve economic order within the concept of sustainable development.
