Direito de defesa no inquérito policial : a falácia da ampla defesa e a solução encontrada nas reformas processuais latino-americanas

Abstract

Resumo : O presente estudo pretende destrinchar o tema dos direitos à defesa na legislação processual penal brasileira, confrontando-a com a Constituição Federal. Partindo do pressuposto de que estamos em um sistema evidentemente inquisitório, o foco da pesquisa consiste no papel defensivo durante o inquérito policial, ou seja, a fase investigativa preliminar ao processo penal em si. Expostas as críticas, propõe-se solução inspirada nos ordenamentos processuais penais latino-americanos: a implantação de uma etapa intermediária e de juízes de garantias, já que, reformados, tais regramentos exibem fórmulas acusatórias – orais, imparciais e democráticas.

Abstract: The present study intends to disentangle the theme of the rights of defense in the Brazilian criminal procedural legislation, confronting it with the Federal Constitution. Assuming that we are in an evidently inquisitive system, the focus of this research is on the defensive role during the police investigation, that is, the preliminary investigative phase of the criminal process itself. In the face of criticism, a solution is proposed inspired by the Latin American criminal procedural orders: the establishment of an intermediate stage and "guarantee judges" (juízes de garantias, in a literal translation), since, when retired, such rules display accusatory formulas - oral, impartial and democratic.
