A desigualdade de gênero acentuada em tempos pandêmicos : a violência doméstica e familiar contra as mulheres durante a pandemia da COVID-19

Abstract

Resumo: Este artigo tem como objetivo analisar as violações de direitos humanos, especificamente contra as mulheres no ambiente doméstico e familiar, durante a pandemia do coronavírus, declarada como tal pela OMS (Organização Mundial da Saúde) em 11 de março de 2020, estando ainda em vigor até o momento da finalização desse artigo. Essa pesquisa tem como intuito fazer uma breve análise, a partir de documentos históricos, políticos e legais, a respeito do desenvolvimento dos direitos das mulheres, especialmente no Brasil, até a incorporação da proteção a mulher ao texto constitucional e o desdobramento em leis infraconstitucionais, como a Lei Maria da Penha. A pesquisa também foi feita a partir de teorias como o Constitucionalismo Feminista para perquirir questões materiais ligadas à violação, como quem pode ser vítima e quem pode ser o autor, o que caracteriza uma relação familiar e doméstica, além das formas de violência abrangidas pelos documentos internacionais e pela legislação brasileira. Faz uma análise comparativa do aumento nos casos de violência doméstica e familiar contra a mulher durante a pandemia do coronavírus e as questões atreladas ao problema, como os motivos de aumento e os motivos da diminuição de denúncias. Por fim, analisa as medidas e iniciativas do poder público de enfrentamento ao problema.

Abstract: This article aims to analyze human rights violations, specifically against women and in the domestic environment, during the coronavirus pandemic. The research traces an analysis, based on historical, political and legal documents, regarding the evolution of women's rights, especially in Brazil, until the incorporation of the protection of women in the constitutional text and the development of infra-constitutional laws like the Maria da Penha Law. The analysis is also based on theories such as Feminist Constitutionalism. It also lists the material issues related to the violation, like who can be the victim and who can be the author, what characterizes a family and domestic relationship, besides the forms of violence covered by international documents and Brazilian legislation. It makes a comparative analysis of the increase in cases of domestic and family violence against women during the coronavirus pandemic and the issues related to the problem, like the reasons for the increase and the reasons for the decrease of reports. Finally, it analyzes the measures and initiatives of the public power to confront the problem.
