A situação dos(as) defensores(as) de direitos humanos no Brasil : uma análise multinível a partir do caso Sales Pimenta vs. Brasil

Resumo: A presente monografia visa realizar uma análise acerca da situação dos(as) defensores(as) de direitos humanos na conjuntura brasileira, tendo como parâmetro a sentença da Corte Interamericana de Direitos Humanos no Caso Sales Pimenta vs. Brasil e o diálogo entre os sistemas de proteção aos direitos humanos. Com base na pesquisa doutrinária e de fontes primárias - resoluções, regulamentos e jurisprudência dos sistemas universal, regionais e local de direitos humanos - são abordados, inicialmente, os distintos conceitos de ativistas em direitos humanos, as atividades por eles(as) realizadas e a sua importância para o fortalecimento de uma sociedade democrática. De forma subsequente, são objetos de exame o direito de defender os direitos humanos e os correlatos deveres dos Estados para sua proteção, sob a perspectiva particular dos sistemas universal, regionais e constitucional, com o escopo de identificar as obrigações do Estado brasileiro no tocante aos(as) defensores(as) de direitos humanos. Consecutivamente, é apresentada uma descrição pormenorizada do Caso Sales Pimenta vs. Brasil, por meio da qual identifica-se os fatos, o procedimento perante o Sistema Interamericano de Direitos Humanos e a sentença proferida pela Corte Interamericana de Direitos Humanos. Continuamente, são expostos os desafios enfrentados pelos(as) ativistas de direitos humanos que atuam no Brasil, através do exame de dados quantitativos de violência, assassinatos, estigmatização e criminalização destes indivíduos, em conjunto com a verificação das medidas adotadas pelo Estado brasileiro para protegê-los e, ao final, expõe-se sugestões de boas práticas, baseando-se nos direitos dos(as) defensores(as) garantidos nas esferas internacional e nacional. Objetiva-se, dessa forma, chamar o Estado brasileiro a cumprir com seus compromissos internacionais, oportunizando um ambiente seguro e propício para a livre defesa de direitos humanos Abstract: This monograph aims to carry out an analysis of the situation of human rights defenders in the Brazilian context, having as a parameter the judgment of the Inter-American Court of Human Rights in the Case Sales Pimenta vs. Brazil and the dialogue between human rights protection systems. Based on doctrinal research and primary sources - resolutions, regulations and jurisprudence of the universal, regional and local human rights systems - the different concepts of human rights activists, the activities they carry out and the importance for the strengthening of a democratic society. Subsequently, the objects of examination are the right to defend human rights and the related duties of the States for their protection, under the particular perspective of the universal, regional and constitutional systems, with the scope of identifying the obligations of the Brazilian State with regard to the human rights defenders. Consecutively, a detailed description of the Sales Pimenta vs. Brazil, through which the facts are identified, the procedure before the Inter-American System of Human Rights and the sentence handed down by the Inter-American Court of Human Rights. The challenges faced by human rights activists working on Brazil are continuously exposed, through the examination of quantitative data on violence, murders, stigmatization and criminalization of these individuals, together with the verification of the measures adopted by the Brazilian State to protect them and, at the end, suggestions of good practices are exposed, based on the rights of defenders guaranteed in the international and national spheres. The objective is, therefore, to call on the Brazilian State to comply with its international commitments, providing a safe and conducive environment for the free defense of human rights
