Repressão estatal preventiva, letalidade policial e legitimação institucional na grande Curitiba (2017-2018)

Abstract

Resumo: O presente trabalho tem por objetivo analisar o discurso jurídico de legitimação e regularização dos casos de RPL (RPL) em processos da Grande Curitiba de 2017 e 2018. Tal legitimação se consuma no que denominamos de Sistema de Justiça Criminal, composto pelas polícias, Promotoria, Judiciário e sistema prisional, e na ritualística processual que produz o arquivamento de tais investigações, principalmente, pelo recurso jurídico do excludente de ilicitude da legítima defesa. O trabalho se debruça sobre o Relato Policial e as manifestações do Ministério Público, pois dentro das peças que compõem o processo, estes representam a síntese das versões e argumentações das duas instituições, e são as principais fontes para se analisar a composição e formação do discurso. O aumento da repressão como um todo, e em especial a repressão letal, se insere dentro de um contexto discursivo, a saber, o regime de acumulação integral, cuja forma estatal corresponde ao Estado neoliberal. Para tanto, lança-se mão de uma discussão a partir do materialismo histórico, quer dizer, do método dialético, para analisar o Estado neoliberal e o neoliberalismo em suas expressões gerais, assim como em sua expressão no período pós-redemocratização brasileira. Dentro desse contexto, pretende-se demonstrar como a tendência repressiva do Estado neoliberal se apresenta necessária à regularização das relações sociais de produção e reprodução do capitalismo contemporâneo.

Abstract: This paper aims to analyze the legal discourse of legitimization and regularization of cases of lethal police repression (LPR) in cases from Greater Curitiba in 2017 and 2018. Such legitimization is consummated in what we call the Criminal Justice System, composed of the police, the Prosecutor's Office, the Judiciary and the prison system, and in the procedural ritualistics that produces the closure of such investigations, mainly through the legal recourse of the excluder of illegality of self-defense. The work focuses on the Police Report and the manifestations of the Public Prosecutor's Office, since, within the pieces that make up the process, these represent the synthesis of the versions and arguments of the two institutions and are the main sources to analyze the composition and formation of the discourse. The increase in repression as a whole, and especially lethal repression, is inserted within a discursive context, namely, the regime of integral accumulation, whose state form corresponds to the neoliberal state. To this end, a discussion based on historical materialism is used to analyze the neoliberal state and neoliberalism in its general expressions, as well as in its expression in the Brazilian post-democratization period. Within this context, we intend to demonstrate how the repressive tendency of the neoliberal State presents itself as necessary for the regularization of social relations of production and reproduction of contemporary capitalism, discussing the Brazilian and American examples.
